The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, October 23, 2023 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Stephens. Roll Call Stephens present, Warner present, Whitehouse present.

Item #2: Statement of compliance with open meetings act-Chairman.

Item #3: Commissioner Stephens led the Pledge of Allegiance and Invocation.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Stephens and seconded by Warner to sign Transcript and Deed on property located in O.T. Drumright Lot 32 & W1/2 of Lot 33, BLK 33 that was sold in Public Sale on 10-16-23. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #8: Motion was made by Stephens and seconded by Warner to sign correct Deed on property located in Section 3 T19N R8E S100 of BEG 430W of E 1 4 COR N296.3 N88'21 W 100 S299.2 E100 to POB that was originally recorded Instrument # I-2023-001305, Book 1456, and Page 889-890 to Carl Jones, this should have been Carol Jones that was sold on 10/2/23. Mortazavi stated the Transcript and minutes are correct with Carol, just the deed was incorrect. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #9: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2023-177 rezoning request CCZ-2119 and lot split CCLS-2927-Circle B Cattle Company per recommendations of CCPC. Rezoning from Agricultural District to Light Residential on tract 1 and 2, with tract 3 remaining Agricultural District to allow lot split. Tract 1 will contain 1.004 acres more or less. Tract 2 will contain 1.004 acres more or less and will meet all requirements for Light Residential District. Tract 3 will remain Agricultural District containing 158.22 acres more or less. This tract will meet all requirements of Agricultural District. All tracts are not within a flood zone. Tracts are surrounded by Agricultural and to the east City of Bristow. There has been no opposition. Applicant is present. The CCPC recommended approval on 10-17-23, along with the Planning Office. Property located at 24538 S. 385th W. Avenue Bristow, OK-Wendy Murray Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #10: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2023-178 rezoning request CCZ-2120-Douglas Meadows per recommendations of CCPC. Rezoning from Agricultural District to Commercial District to allow mini storage. Tract will contain 4.8 acres more or less and meet all requirements of Commercial District. Tract is surrounded by Agricultural. There has been no opposition. Applicant is present. The CCPC recommended approval on 10-17-23, along with the Planning Office. Property located at 20564 W. HWY 55 Bristow, OK-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #11: Motion was made by Warner and seconded by Whitehouse to continue Healthcare Plan with Community Care, accepting a 3.0% increase, Telemedicine Plan (Tele-Doc) accepting a 0% increase, APL accepting a 0%, Guardian's renewal for vision accepting a 0%, dental accepting a 0%, Life Insurance accepting a 0%, Retiree Life Insurance accepting a 0%, Voluntary Life, Short-Term and Long-Term Disability Plan accepting a 0% increase for 2024 employee health insurance. Lisa Barton, spoke to the Board on current renewal. The claims data was reviewed currently we are at 109% loss ratio. We do have several high claimants, but we do have a couple of them dropping off for next year. Last year's numbers were compared to current year. We are in a good place with a 3% increase. I think the long-term partnership with Community Care helped, but at the end of the day we want what is best for the employees of Creek County. We did not see any increase in the other plans offered by the County this year. Retirees did not see an increase this year, and this has not happened in several years. Overall, the renewal is a great offer. Stephens thanked Barton and Tandra McClellan for all their hard work on the renewal process. Warner mirrored that comment. Also, what is the overall medical inflation number that you are see asked Warner. Barton stated anywhere from a 7 to 12% increase is what we have been seeing.   Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #12: Motion was made by Stephens and seconded by Warner to sign Resolution#2023-179 changing the speed limit from 45 MPH to 25MPH on S. 49th W. Avenue from W. 158th St. S. to W. 151st St. S., making that section a school zone, and changing the speed limit on S. 49th W. Avenue from W. 158th St. S. to W. 161st St. S. from 45MPH to 35MPH in District #1. Stephens stated that the school has moved the pickup and drop off and the traffic has increased off of 49th. We had added a stop sign to assist with the traffic, but I think this new speed is needed for safety of the school. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #13: Motion was made by Warner and seconded by Whitehouse to sign 911 Management Authority State-Local Agreement for an E-911 Sustainability Grant, awarding $3,219.00, to the County Public Safety Answering Point (PSAP). Bret Bowling stated the Sheriff was granted monies for this grant; we are not sure where we will spend the monies at this time. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #14: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-180 to create E-911 Sustainability Grant Fund Accounts 1569-2-3601-110; 1569-2-3601-2005; 1569-2-3601-4110, Revenue Code 9241. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #15: Motion was made by Stephens and seconded by Warner to sign Juvenile Detention Contract with Okmulgee County for the remainder of 2023-2024 fiscal year at $85.00 per child, per day. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #16: Motion was made by Stephens and seconded by Warner to sign Juvenile Detention Contract with Muskogee County for the remainder of 2023-2024 fiscal year at $85.00 per child, per day. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #17: DISCUSSION ONLY/NO ACTION notice of Memorandum of Understanding with Kiefer Public Schools Campus Police. Bret Bowling, Sheriff stated this is the first school that I am aware of that is wanting to have a joint-partnership with campus police with Creek County. This means all officers must be CLEET certified. We will dispatch and share our GEO Safe boundaries with Kiefer Public Schools. Stephens discussed that Vo-Tech is the only other school locally that has campus police. Bowling stated he will file the Memorandum once it has been approved by Kiefer with the County Clerk.

Item #18: Motion was made by Stephens and seconded by Warner to award Project#CO0157-9/27/23 Courthouse Coping Repair to Alva Roofing Company, in the amount of $16,700.00. Jana Thomas, Purchasing Agent stated we notified five vendors and only received on quote. Stephens stated he believes that is a fair price and is confident that this will fix the issue with the roof. There was discussion of the previous bid process and how we come to now getting three written quotes. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #19: Motion was made by Warner and seconded by Whitehouse to approve conveyance of county-owned property located in M Jones Addition Lots 6, 7, and 8, BLK 42, property address is 720 W. Walnut Street Drumright, OK to the Creek County Home Finance Authority pursuant to 19 O.S. § 349. Rick Engleman, Treasurer and Warner spoke of the Creek County Home Finance Program with Central Tech. This is three lots that was in the Resale Auction that did not sale, it then went to the County stated Engleman. We would like to recommend that the Board donate it to the Authority, so that construction can occur and the new home will be placed on the tax rolls. Warner stated this is a win, win for all parties. The school gets to use their skills to build the home, the Authority gets to sale and make some money off of the sale and then the county gets to receive some of the new ad valorem taxes on the property, once its sales. Warner stated the Authority utilizes this program in Drumright, Oilton and Cushing. This year they are in Cushing, next year will be Drumright, where this project will start. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #20: Motion was made by Stephens and seconded by Warner to sign Resolution#2023-181 directing the Creek County Treasurer to credit the Creek County Health Department M&O Fund 1216-3-5000-2005/MD2 with a check from Sooner Hospitality, LLC in the amount of $238.00, as reimbursement for payment to wrong vendor that was made out to Holiday Inn Express/Sooner Hospitality, LLC, as per 62 O.S. § 335, and procedures implemented by the State Auditor's Office.  Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #22: Motion was made by Stephens and seconded by Whitehouse to approve Utility Permit from Creek County Rural Water District #1 per County Specs for 1" water service by boring, size of line 1" poly, to cross W. 171st St. S. approximately .33 miles E. of 241st W. Avenue and W 171st St. S., further described as 1740' E. of the S.W. corner of Section 28, T17N, R10E in District #1. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #21: Motion was made by Stephens and seconded by Whitehouse to sign Resolution#2023-182 directing the Creek County Treasurer to credit the Opioid Abatement Settlement-All Settlement, No-Sub Department Fund 1251-3-6700-2005 with a check from Milestone & Co., LLC in the amount of $31,851.23, as Per-Appeal Allocation of Entity, minus 15% for Attorney Fees, as per 68 O.S. § 335, and procedures implemented by the State Auditor's Office. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #23: Motion was made by Stephens and seconded by Whitehouse to approve Utility Permit from Creek County Rural Water District #2 per County Specs for water service line by boring 64 ditch to ditch, size of line 1", size of casing 2" to cross S. Hickory St. approximately .23 miles N. of W. 161st St. S. & South Hickory St., further described as 1,246' N. of the S.E. corner of Section 22, T17N, R11E in District #2. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #24: Motion was made by Warner and seconded by Whitehouse to approve Utility Permit from ONE Gas Inc. per County Specs for ¾" natural gas pipeline by boring, size of line ¾", to cross 6433 S. 161st W. Ave approximately 3.40 miles W. & 3.49 miles N. of SH 97 & SH 166, further described as 1,626' S, of the S.E. corner of Section 6, T18N, R11E in District #2. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #25: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. No update at this time. (1) No Road and Bridge Projects at this time.
