The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, December 18, 2023 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Stephens. Roll Call Stephens present, Warner absent, Whitehouse present. Warner joined the meeting at 9:01.

Item #7: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-201 rezoning request CCZ-2122-Michael Swagerty per recommendations of CCPC. Rezoning from Light Residential District to Agricultural District to allow a second dwelling for a family home on 10 acres or more. The subject tract will meet all requirements. Tract also has a public right-of-way on file. There has been no opposition. Applicant is present. The CCPC recommended approval on 12-12-23, along with the Planning Office. Property located at 7141 S. 77th W. Avenue Tulsa, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #8: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-202 rezoning request CCZ-2123 and lot split CCLS-29-31-Jackie D Carner per recommendations of CCPC. Rezoning from Agricultural District to Light Residential District on tract 2 and tract 1 will remain Agricultural District to allow lot split. Tract 1 will contain 5.3 acres more or less and meet all requirements. Tract 2 will contain 1 acre more or less and meet all requirements. Tracts are not located in a flood zone. Tracts are surrounded by Light Residential and Agricultural. There has been no opposition. Applicant is present. The CCPC recommended approval on 12-12-23, along with the Planning Office. Property located at 7572 W. 191st St. S. Mounds,OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #9: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-203 Final Plat approval for Sunset Meadows CCFP-02-Sunset Meadows-Ritchie Land Company per recommendations of CCPC. The subdivision will consist of 14 tracts on 160 acres. Murray stated the preliminary plat was approved on 9-25-23. There has been no opposition. The CCPC recommended approval on 12-12-23, along with the Planning Office. Applicant is present.  Property located at the northwest corner of S. 49th W. Ave and W. 181st St. S. Mounds, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #10: Motion was made by Warner and seconded by Warner to sign Resolution#2023-204 rezoning request CCZ-2124 and lot split CCLS-2934-Dana Tramonte per recommendations of CCPC. Rezoning from Agricultural District to Residential Manufactured Home District on tract 1 and tract 2 to remain Agricultural District to allow lot split. Tract 1 will contain 2 acres more or less and meet all requirements. Tract 2 will contain 4.28 acres more or less and meet all requirements. Tract is surrounded by Agricultural District. There has been no opposition. Applicant is present. The CCPC recommended approval on 12-12-23, along with the Planning Office. Property located at 35917 W. 36th St. S. Mannford, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #11: Motion was made by Stephens and seconded by Whitehouse to sign Resolution#2023-205 denying approval of rezoning request CCZ-2125-Soltani Properties, LLC per recommendations of CCPC. Murray stated this tract contains 320 acres and surrounded by Agricultural District. This subject tract has been out of compliance, although we have not received any written complaints. The CCPC recommended denial on 12-12-23, along with the Planning office. Applicant is present. Property located at 10996 S. 193rd W. Ave, Sapulpa, OK.-Wendy Murray, Planner. Stephens stated they are trying to bring commercial into the agricultural district. The CCPC recommended denial and they are a recommending body to our board for decisions. I would have to agree.  Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #12: Motion was made by Warner and seconded by Whitehouse to pass for one week until 12-27-23 discussion and possible action to consider changing the county Emergency Service Numbers (ESN) to reflect county jurisdiction for the 911 Public Safety Answering Point (PSAP). Bret Bowling, Sheriff spoke to the Board about protesting the boundaries since 2017. In 2019 the County paid for a study through Mission Critical to do a PSAP study, we have had meetings over the years, training has taken place and again in August was another meeting. With all of this we still have not gotten anywhere, so this has been no secret. There have been meetings with Lance Terri, Commissioner Warner and our District Attorney's Office on the counties current PSAP's and of the numbers currently and what the numbers will look like in 2024. Currently there are four schools that are not represented in the unincorporated areas and for public safety that should not be happening and should change for safety. There was discussion of the timeframe that the item was placed on the agenda, but with no efforts in coming to a solution, I had to place the item on the agenda. I take offense to some statements being said that the Sheriff's Office acted spontaneously and is being unreasonable. The redistricting of the ESN is essential, it is the best decision. This would place value guidelines and experience as my research shows over the last 10 years. This is needed to ensure the absolute public safety for our citizens, it is out of my hands now and the decision is the Boards. I know Commissioner Warner will probably pass it out a week, but agrees this is the right thing to do. Stephens touched base on there are only two counties that do their 911, the way we do. All others have one. I have had discussion with Dorita Huckabee and this is a recommended solution for our county. We have to start somewhere and this is the time to look at consolidating to one PASP and represent the unincorporated areas that the Sheriff has a duty to do. If we make a decision today and we have to come back to the Board to look at some issues to review and make alterations, then we can do that, as well. Warner stated this is the right thing to do, I have prepared a proposal. I am not interested in listening to the numbers, but I would like to hear everyone's input. We need to look at the Next Gin system and see how we consolidate the number of PSAP's. Elaine Geerds voiced concerns of a terrorist attack and how the system could be affected. Could the response time be affected. Shamrock VFD, Drumright FD, Mannford Police Chief, and Bristow FD all voiced concerns over the delay of response times with the proposed changes and then having to transfer the call back out the PSAP that may have already received the call. EMS, Boomer voiced concerns with not being one of the PSAP holders, but receiving over 12,000 calls that they dispatch for and not receiving any funding. Will the Board look at funding for the Ambulance. David Widdoes, City of Sapulpa spoke to the Board we have not been in any conversations that have been taking place. I had no communications with the Board on this item either. We have reviewed the study and have done some of our own research. I would like to thank the Board for all that you do. At the end of the day, it is about lives, safety of our families and residents and who we represent. Sapulpa has one of the oldest PSAP's in the county and serve over 40,000 people. We empower our fire department with funds from 911 and they are devoted in servicing the public. We have been rated the #1 PSAP holder. We have done some of our own research and study over the last thirty years. We need to become co-equal in this effort and come to an agreement on how this process should happen. I have reviewed the Emergency Telephone Act and 911 Emergency Act and it is my opinion that the Board does not have the authority to change the geographic boundaries. Widdoes went through the process that the city would have to approve to resend boundaries or alter. We need to keep in mind public safety and the public demands our response time as it has shown in the past thirty years. We are the fastest city to respond with a time of 55 seconds. There had been discussion of forming a trust back in 2020 and that never formed to my knowledge. We are committed to exploring one to two PSAP options. But we are against changing unincorporated areas that the city has serviced and the negative impact of funds this proposal will have on the City of Sapulpa. There needs to be something in place before the boundaries or changes should take place. Warner stated the existing agreement for 911 wireless gives us the ability. We will have to do some research on the statute. Fire boundaries were discussed and how they came about due to lack of funding available through the county. This then established fire contracts entered into by cities and towns. Widdoes stated the Sapulpa facility has no room for growth this is stated within the study and all the other eighty-eight problems stated as well. Warner reviewed his proposal and apologized for the lack of communication on this effort of the 911 system. I think we establish a ten-person board that would make recommendations on how we move forward. Maybe the board looks at a 911 director to stay within the national standards. We know that the Sheriff has stated that 80% of all calls are law enforcement related and we need to look at the funding that will take effect in 2024. The other opinion is the State will freeze the funding until a decision can be made by our county. We need to look at the future and see what is the best way to get there. Stephens stated we have a proposal in front of us from the Sheriff, we need to approve and then the information will be sent to the state to review and all PSAP holders will have a chance to protest, the decision to change the boundaries lies with the state and not the Board. We are just the governing Board for the Sheriff and are making a recommendation to the State. It is the Sheriff's duty to serve the unincorporated areas of the county, he does not have a choice. This will not affect the current funding, by the time the new funding starts there should be an agreed upon boundary line with funding as well. Warner agreed that the first step is consolidating the ESN numbers. Whitehouse stated that the communications is the key to the consolidation and we value each and everyone's opinions in the cities and towns that we represent. To bad these discussions couldn't of happened six months ago, we could have been a lot future down the road.  Sapulpa Chief Reed spoke briefly and presented his numbers of call received and transferred to Sheriff for 2022-2023. Out of 19,724 calls, we transferred 1,029 to the Sheriff, that is 5.24%. I have not been a part of any communications of this effort and I am not for the boundaries changing. There was discussion of different conversations with Terri and conflicting information given to different entities on duties and timeframes. Reed agreed he doesn't think the Board has the authority to change the boundaries. He has also researched the 911 Management Act Code 145 Chapter 15.  Joe Thompson, Under-Sheriff in closing stated that the Board has listened to everyone's concerns. We love seeing everyone's interest, but we have been working on this for years and it keeps stalling. This is the beginning of the changes that need to take place, we cannot ignore what is in front of us today. We encourage the Board to approve the proposed ESN changes and let the protest period and the state make the final decision. We need to work toward a unified 911 system and service the unincorporated areas making sure that calls go to the correct places. There was further discussion of the proposed information and Andrew Goforth reminded the Board to stay on the current agenda item. This item had two other motions that failed. This item will be placed on next week's agenda for further discussion.  Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #13: Motion was made by Stephens and seconded by Warner to sign Resolution#2023-206 revising Resolution#2023-150, for non-participation in the County Road Machinery and Equipment Revolving Fund at ODOT for District #1 and District #2.  Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #14: Motion was made by Stephens and seconded by Whitehouse to award Bid#24-7 3-Month Asphalt & Emulsion Products and Services designated per district. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #15: Motion was made by Stephens and seconded by Whitehouse to award Bid#24-8 6 Month Bridge & HWY Materials and Professional Services for District #1 and District #3 and pass awarding of District#2 until 12-27-23 to award. Warner stated that he needs more time to evaluate the costs due to Quapaw not bidding some products. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #16: Motion was made by Warner and seconded by Whitehouse to sign division order between Creek County and Above Ground Level LLC, for Elephant Well 1-5 well, located on property located in Section 5, T19N, R8E, with 0.0005667 interest. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #18: Motion was made by Warner and seconded by Whitehouse to approve Utility Permit from Creek County Rural Water District #1 per County Specs for 2" water service line, by boring, size of line 2" poly, to cross S. 241st W.
