The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, May 22, 2023 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Newt Stephens, Jr. Roll Call Stephens present, Warner present, Whitehouse present.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-60 rezoning request CCZ-2102 and lot split CCLS-2883-Michael and Lois Newman per recommendations of CCPC. Tract 1 will contain 1.19 acres more or less and will remain Light Residential. Tract 2 will contain 0.67 acres more or less rezoning from Light Residential to Commercial District to allow the continued use of existing business. Both tracts will meet all requirements. The tracts are surrounded by Light Residential, Agricultural, and the Town of Kiefer. Murray stated we did receive a call about the rezone. This will bring the existing 20-year business into compliance. Applicants are present. The CCPC recommended approval on 5-16-23, along with the Planning Office. Property located at 14311 S. 49th W. Ave, Kiefer, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #8: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-61 rezoning request CCZ-2104 and lot split CCLS-2891-Brandon and Julia Fiery per recommendations of CCPC. Tract 1 will contain .95 acres more or less and will remain Agricultural. Tract 2 will contain 15.2 acres more or less rezoning from Agricultural District to Light Residential for existing home. Both tracts will meet all requirements. There was no opposition. Applicant is present. The CCPC recommended approval on 5-16-23, along with the Planning Office. Property located at 20204 W. 66th St. S. Sand Springs, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #9: Item #8: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-62 rezoning request CCZ-2105 and lot split CCLS-2897-Joe and Jessica Conley per recommendations of CCPC. Tract 1 will contain 140.77 more or less. Tract 2 will contain 1.73 acres more or less rezoning from Agricultural District to Residential Manufactured Home District for existing home. Tracts are surrounded by Agricultural. Both tracts will meet all requirements. We did receive a few calls. Applicant is present. The CCPC recommended approval on 5-16-23, along with the Planning Office. Property located at 19521 S. 145th W. Avenue Sapulpa, OK 74066.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #10: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-63 rezoning request CCZ-2106 and lot split CCLS-2889-RK Trust per recommendations of CCPC. Tract 1 will contain 1 acre more or less rezoning from Agricultural District to Light Residential District. Tract 2 will remain Light Residential and Agricultural District containing 6.96 acres more or less. Murray stated Tract 2 will have dual zoning. Tracts are surrounded by Light Residential and Agricultural. Both tracts will meet all requirements. There was no opposition. Murray stated this is just bringing the tracts into compliance. Applicant is present. The CCPC recommended approval on 5-16-23, along with the Planning Office. Property located at 29665 Old HWY 66 Bristow, OK.-Wendy Murray Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #11: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-64 rezoning request CCZ-2107-Brett and Dwaina Smith per recommendations of CCPC. Rezoning from Agricultural District to Light Residential for existing home. Tract will contain 1 acre more or less. Tract is surrounded by Agricultural and Residential. There was no opposition. Murray stated this is bringing the tract into compliance. Applicant is present. The CCPC recommended approval on 5-16-23, along with the Planning Office. Property located at 29625 Old HWY 66 Bristow, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #12: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-65 rezoning request CCZ-2103 and lot split CCLS-2888-HTN Properties LLC per recommendations of CCPC. Tract A is extending Commercial District to allow for future expansion containing .5 acres more or less. Tract A will be tied to the tract to the west. Tract B will remain Light Residential containing 8.5 acres more or less. Tracts are surrounded by Agricultural, Residential, Light Residential, Commercial and Industrial Districts. We have received several calls with concerns of odor, smells when the doors are open. Murray stated the conditions set by CCPC. Applicant is present. The CCPC recommended approval on 5-16-23, along with the Planning Office. Property located at 11131 W. 71St St. Sapulpa, OK 74066.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #13: Motion was made by Warner and seconded by Whitehouse to sign Supplemental and Modification Agreement to the Project Maintenance, Financing, and Right-of-Way Agreement on JP3047304, STP-219D (109)CI, 30473(04) Bridge No. 23 over Tributary to Little Salt Creek to add federal funds and update estimates regarding project in the amount of $819,916.00, as follows $630,378.00 old funding table. New funding table $1,531,901.00, less $1,104,443.00 STBG Fund and $819,916.00 from CIRB Funds. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #14: Motion was made by Warner and seconded by Whitehouse to acknowledge the State Auditor's Office audit of county financials pursuant to 19 O.S. § 171 and acceptance of engagement letters of the same. Warner stated this is for Fiscal Years ending 21 and 22. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #15: DISCUSSION ONLY/NO ACTION on notice of audit report of the Circuit Engineering District #1 for the period of July 1, 2021, through June 30, 2022, by the State Auditor's and Inspector's Office. Stephens stated we will accept the audit and file with all the county audits.

Item #16: Motion was made by Stephens and seconded by Warner to sign Resolution#2023-66 surplussing nine stackable chairs, two side tables, two wooden chairs and two sets of beam seats for the Sheriff's Office and Resolution#2023-66A disposing of the same to be junked. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #17: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-67 removing Requesting/Requisitioning Officer Stephanie Brandsness and adding Anthony Beard for the Silver City Volunteer Fire Department Accounts 1321-2-8313-2005 and 1321-2-8313-4110. Mortazavi stated this request was sent in from the Fire Department. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #18: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. (1) Motion was made by Stephens and seconded by Warner to approve Transfer $79,006.38 from 1566-1-2000-2005 ARPA M&O Commissioners FY2022-2023 to 1566-1-2000-2005 ARPA M&O Commissioners FY2023. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. (2) No Road and Bridge Projects at this time. (3) Motion was made by Stephens and seconded Whitehouse to approve the use of ARPA Payroll Funds for Feasibility Study for combined Emergency Management, Sheriff's Office, and 911 Call Center Building in the amount of $16,800.00. Project number 1566-1.14-0400-1110. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. Stephens spoke about the request for the feasibility study. I have called BKL and Reed Designs. Reed never called back, so this price quoted is from BKL. The Board reviewed what the study will include. Brooke Delong expressed concern with the study that they include what it would cost to remove the asbestos and black mold from the current location. Stephens spoke to the Board about the recent Trust Meeting. The Trust is willing to help with the project proposed, as much as they can. Stephens informed the Board that we have received an External Request from Milfay Volunteer Fire Department for a water well. Mortazavi stated I have been forwarded a copy via email. We have done some research and cannot find where they have an active SAMS.GOV registration. We did find where they had one that expired in 2019. Mortazavi stated with any external requests the requestors, along with suggested vendors must be registered in SAMS.GOV and be active. We have been talking about this for the past year or two. Mortazavi confirmed with Andrew Goforth that all requestors must have an active SAMS.GOV registration and do not fall under the counties correct. Goforth stated correct, anyone receiving federal funds must be registered and be active, also have a UEI. Stephens stated the county has been lucky to receive the 13.9 million dollars in ARPA Funds and we have done projects that benefitted the whole county and not just a single area. We have learned along the way on what the funds could and could not be utilized on to the best of our abilities. I think we have a done a good job on the project chosen. At the end of the day, we have duty to apply the funds where it best serves the most people. We have allocated 1.5 million to water and sewer. We have been very transparent as to where the funds have been spent from equipment, command center, to our rural roads. We have equipment from Emergency Management that will service all of Creek County and not just a single department. I wished we had millions to give to people and I know some will be upset, but we do have to make a decision. With the Roads we have impacted the rural area and assisted with better roads for citizens, police, ambulance, schools and fire departments to travel on. I stand behind this project being needed and it is what will serve the most people in the county.
