The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, August 14, 2023 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Newt Stephens, Jr. Roll Call Stephens present, Warner present, Whitehouse present.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Whitehouse and seconded by Warner to appoint Rick Engleman, as the Creek County Treasurer. Whitehouse stated he appreciates everyone that took time to turn in their resume. We had two really good candidates and I think with it being an interim position, Rick Engleman would be the best candidate. Warner stated he agreed, we had some really good candidates and it is really hard to just pick one. I have had community input and either one would have the experience required and would be qualified. I believe Engleman is a good decision, as well. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. A motion was made by Stephens and seconded by Whitehouse to set the start date for Treasurer to be September 01, 2023. We will work on getting the swearing in process in place as well. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #8: DISCUSSION ONLY/NO ACTION to consider signing resolution to participate in the County Road Machinery and Equipment Revolving Fund at ODOT. Whitehouse stated since Creek County did not get approved last year, I was told we would move to the top of the list. Stephens stated this item was on the agenda for information purposes and if anyone wants to participate get with Dana Logsdon, Deputy Commissioner on what pieces of equipment you are interested in. This item will be back on the agenda next week.

Item #9: Motion was made by Stephens and seconded by Whitehouse to let for Bid#24-4 Purchase of 5 or more refurbished 800 mhz handheld portable radios for the Sheriff. Bret Bowling, Sheriff stated that these are for our Reserve Deputies and we are being conservative with choosing refurbished. The cost difference for a new one is around $6,000.00 and a refurbished is about $2,600.00. Stephens stated we need to make sure that there is language for the radios to be compatible with the OKWIN System (P25) system. Bowling stated he will make sure there is sufficient language in the bid to be compatible with the current system. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #10: Motion was made by Stephens and seconded by Warner to approve detention contract with Wagoner County for the remainder of the 2023-2024 fiscal year with the Sheriff. Bowling stated this is our first year to contract with Wagoner County, this is part of us working with OJA. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #11: DISCUSSION ONLY/NO ACTION to consider surplus and disposal of equipment for the Creek County Sheriff's Office. Bowling stated this is the Dodge Charger that was side swiped from last week's agenda item. We are needing to surplus this to the insurance company. Bowling stated we have spoken to the insurance company and they are going to adjust the original replacement value and consider the upgrades to the vehicle.  Stephens stated the resolution does not contain all the equipment and upgrades to the vehicle. Let's pass this one week, so you can get a true cost on the resolution to turn in. Warner asked if all the equipment will be re-cooped, Bowling stated some will be able to be. This item will be on next week's agenda for action.

Item #12: Motion was made by Stephens and seconded by Whitehouse to direct Jennifer Mortazavi, County Clerk to email a copy of the proposed updated handbook to all elected officials. Stephens stated Mortazavi, Tandra McClellan and himself had been working on this for a couple of weeks. I think we have got all the updates that are needed and we can make adjustments as they come about. We are needing to get some of the current language updated, soon, it's been too long. We will let the elected official review the proposed changes and have this on for next week for a decision or discuss anyone's concerns. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #13: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. None at this time. (1) No Road or Bridge projects at this time.
