The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, September 25, 2023 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:03 a.m. by Chairman, Stephens. Roll Call Stephens present, Warner present, Whitehouse present.

Item #2: Statement of compliance with open meetings act-Chairman.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2023-159 rezoning request CCZ-2117-MSP Investments per recommendations of CCPC. Rezoning from Agricultural District to Industrial District to allow gravel plant, recycling concrete into gravel. Tract will contain 6.0 acres more or less and will meet all requirements. The existing home will be turned into an office. Tract is surrounded by the city on the North, East and West sides and Agricultural on the Southside. Tract is not in a flood zone. There as been no opposition. Applicant was not present. The CCPC recommended approval on 9/19/23, along with the Planning Office. Property located at 23833 S. 369th W. Avenue Bristow, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #8: Motion was made by Stephens and seconded by Warner to sign Resolution#2023-160 approval of Preliminary Plat for a residential subdivision CCPP-2023-04-Sunset Meadows, Ritchie Land Company per recommendations of CCPC. Preliminary Plat Sunset Meadows will consist of 14 tracts on 160 acres, with 10-acre tracts. East Central Electric will run lines overhead, Creek County Rural Water District 7, has approved water use. District 1, Newt Stephens Jr. will build culverts and Ritchie Land Company will lay all pipeline fence and corner posts. Murray spoke about lot 3 needing to meet with Floodplain Administrator before development of lot. The subdivision will have all county-maintained roadways, that are already in place. Stephens stated this will be a good little addition and the applicant worked well with Planning and Floodplain Offices.  There has been no opposition. Applicant present. The CCPC recommended approval on 9/19/23, along with the Planning Office. Property located at NW corner of S. 49th W. Ave and W. 181st St. S. in Mounds, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #9: Motion was made by Stephens and seconded by Warner to sign Resolution#2023-161 rezoning CCZ-2118-Adaptable Land Management per recommendations of CCPC. Rezoning from Agricultural District to Industrial District to allow machine shop, electrician services, home repair services and off-site service contractor. Tract will contain 30 acres more or less. Tract will meet all requirements. Tract is surrounded by Agricultural and Industrial to the North, East and South, to the West is City, Agricultural and Industrial. The applicant has been instructed to meet with the Flood Plain Management for proper steps for the back building on property. Stephens addressed concerns with multi use of the property and more than one individual using property as a business with multiple address and tracking purposes. Applicant stated he hears the concern and there will only be one person doing the multiple business. So, one address is all that is needed. Stephens explained there is a process if there is a need for more and an option to have the property platted into industrial park.  There have been a few concerns on taken. Applicant is present. The CCPC recommended approval on 9/19/23, along with the Planning Office. Property located at 9023 Frankoma Road Tulsa, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #10: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-162 approval of Preliminary Plat for residential subdivision CCPP-2023-03-Shamrock Addition, Shamrock Land LLC consisting of 90 tracts on 803.4 acres. Murray stated the landowners will be responsible for all utilities to be installed. The tract is surrounded by Agricultural District. We have had some concerns with the water source. The tract will have one entrance off of HWY 16. Applicant is present. The CCPC recommended approval on 9/19/23, along with the Planning Office. Property located at ¼ mile East of S. 513th W. Avenue off of W. HWY 16, in Depew.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #11: Motion was made by Warner and seconded by Whitehouse to approve proposed text amendment to the Creek County Planning and Zoning Regulations section 4.12.2-A and 5.5.1-D to clarify that a second dwelling on Agricultural uses can allow a second family dwelling. Murray stated the two sections contradicted each other and this will allow clarification between the two sections. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #12: Motion was made by Warner and seconded by Whitehouse to approve the Creek County Treasurer's Financial Statement for fiscal year 2023-2024. Gloria Ware, Deputy spoke to the Board, we have updated some verbiage on the funds, per the Auditor's recommendations. We have added the Rural Road Improvement District and Opioid Abatement Accounts, as well. We also have reflected the two transfers in the Trash Cop and Assessor accounts. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #13: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-163 CD Investments for Creek County General Funds outlining the amounts, terms, rate and matured dates. Engleman, Treasurer asked the Board if they had any liquidity needs that he needs to be aware of. The Board stated no, not at this time. The Board thanked Engleman on the transparency and the good line of communication of the investments. Stephens stated the investments have always happened; they just have not be as transparent until now. Warner asked Engleman about the interest rates, it is pretty amazing currently. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #14: Motion was made by Stephens and seconded by Whitehouse to sign Resolution#2023-164 surplussing a DCP L5500DN Copier, Whirlpool Refrigerator INV#618.001 Serial #211912001, Sofa INV#618.002, TV INV#222.001, DVR INV#699.99, 2 Acer Monitors, 1 keyboard and mouse, 2 Desk Risers for the Treasurer's Office and Resolution#2023-164A disposing of the same to be transferred to Gypsy Public Schools by Inter-Governmental Transfer 2 monitors,1 Keyboard and mouse, 2 Desk Risers, DCP Copier and Refrigerator and sofa, TV and DVR to be junked. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #15: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-165 adopting Rural Economic Action Plan Grant for 2023/2024 INCOG REAP and authorizing the Chairman to sign. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #16: Motion was made by Stephens and seconded by Warner to sign Resolution#2023-166 adopting a reimbursement of up to $150.00 annually for Highway District Employees to use towards the purchase of personal protective equipment work boots. Stephens stated there has been a lot of research done by Jana Thomas, Purchasing Agent. There was a resolution back in 2000, then on 3/3/05 the minutes stated $65.00 for reimbursement, then on 3/14/05 the minutes reflected $75.00 reimbursement. There was not agenda item to approve the increase. Stephens discussed the option to allow the reimbursement and then have an additional policy within your district. District 1, will develop a policy for work boots to be worn only for work use, we will resolution them out each year. We will have the employees fitted each year and then purchase them. District 2 and District 3, stated they just like the up to $150.00 annual reimbursement. Stephens provided the board with some boot examples ranging from $130.00 cheap pair to $200.00 decent pair and you can get more expensive pairs as well. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #17: Motion was made by Stephens and seconded by Whitehouse to give notice of sale at Manheim Public Auction for vehicles surplussed by the Creek County Sheriff's Office, Resolution#2024-133. Vehicles are scheduled for auction on October 5, 12, 19, 26 and November 2, 2023. Joe Thompson, Under Sheriff stated we have two vehicles going back to the auction, one that had a lost title and the one that was transferred to District 2, then transferred back to the Sheriff. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #18: Motion was made by Stephens and seconded by Whitehouse to sign Resoluiton#2023-167 surplussing 8 Workpro Quantum 900 BLK Office Chairs and 1 BLK Office Chair for the County Clerk's Office and Resolution#2023-167A disposing of the same to be traded in to Merrifield for a credit towards new chairs, in the amount of $385.00. Mortazavi stated we are just upgrading the office chairs. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #19: Motion was made by Stephens and seconded by Warner to approve Utility Permit from Creek County Rural Water District #7 per County Specs by boring, size of line 1", size of casing 2", to cross S. 84th W. Ave approximately .2 miles N. of Jct. S. 191st W. Ave, further described as 690' B. of Section 1, T16N, R11E and Section 6, T16N, R11E in District #1. Stephens stated this is a graveled road and if they need to cut it, it will be fine. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #20: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. No update at this time. (1) No Road and Bridge Projects at this time.
