The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, May 01, 2023 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Newt Stephens, Jr. Roll Call Stephens present, Warner present, Whitehouse present.

Item #6: DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.) Stephens informed the Board that the Care House located at 23 S. Oak Sapulpa has a major water leak under the foundation. We have recently replaced the water line to the house that was quite extensive in cost. I think we need to reevaluate the property and see if there are some different alternatives. The current house has just become a money pit and before we sink anymore into it, I would like to see what else we may be able to do. I have notified the two that utilize the house and will get some more information to provide to the Board.

Item #7: Motion was made by Warner and seconded by Whitehouse to approve public sale auction of property located in O.T. Sapulpa N1/2 W50 Lot 2, BLK 12 to Carl Wallace for $179.00, plus $100.00 filing and publication total of $279.00. There were no other parties present. Debi Mainard, Treasurer Deputy stated the property has no 911 address. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #8: Motion was made by Warner and seconded by Whitehouse to approve public sale auction of property located in O.T. Bristow Lot 10, BLK 17 to Carl Wallace for $339.00, plus $100.00 filing and publication total of $439.00. There were no other parties present. Debi Mainard, Treasurer Deputy stated the property address is 507 E. 11th Avenue Bristow. The property does not contain any structures. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #9: Motion was made by Warner and seconded by Whitehouse to approve public sale auction of property located in Business Mens all of Lot 3 and 4, BLK 8 to Carl Wallace for $255.00, plus $100.00 filing and publication total of $355.00. There were no other parties present. Debi Mainard, Treasurer Deputy stated the property has no 911 address. Mainard stated the property used to contain a mobile home, but it has been removed. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #10: Motion was made by Warner and seconded by Whitehouse to approve public sale auction of property located in O.T. Bristow Lot 1, BLK 18 to Yolanda Brandon Sims for $470.00, plus $100.00 filing and publication total of $570.00. There were no other parties present. Item #11: Motion was made by Warner and seconded by Whitehouse to approve public sale auction of property located in Krumrei Lot 36, BLK 5 to Yolanda Brandon Sims for $213.00, plus $100.00 filing and publication total of $313.00. Item #12: Motion was made by Warner and seconded by Whitehouse to approve public sale auction of property located in Krumrei Lot 35, BLK 5 to Yolanda Brandon Sims for $225.00, plus $100.00 filing and publication total of $325.00. There were no other parties present. Debi Mainard, Treasurer Deputy stated the property address is 731 E. 5th Avenue Bristow.  Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #13: Motion was made by Whitehouse and seconded by Warner to authorize Whitehouse to sign and approve payment for a temporary easement for Project J/P30474(04); CIRB-219-C(XXX)RB; Creek County; Parcel 2.1, in the amount of $500.00, in District #3. Whitehouse stated this is for a temporary easement for the bridge S. of Depew and ODOT will pay. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #14: Motion was made by Stephens and seconded by Whitehouse to correct a scrivener's error in the Section 4.5 Commercial District, 4.5.3 Special Exception Uses #11 from minimum to maximum on Recreational Vehicle Park maximum 10-12 RVs per acre. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #15: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-50 approving partial tuition cost for CDL training for employees, specifically Timothy Caleb Richison, Jr. Warner stated this is a partnership with Workforce on funding available to fund partial payment of a CDL certification at the Central Vo-Tech in Drumright. This program will pay $4200.00 of the $4800.00 total cost. Warner stated I would like to see how this goes on the first one and then maybe the county might want to utilize this program. Mortazavi asked if this program was different then what Covey Murray and Jacob Pilgram was designated to teach for county employees. Warner stated that we are having a hard time with employees passing the written test first, before they train with Murray and Pilgram. This class offers the full training required. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #16: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-51 removing Requisitioning Officer Joy Naifeh and adding Vicki Martin for the Creek County Election Board (0001-1-2200-1110/SL1A; 0001-1-2200-1130/SL1B; 0001-1-2200-1310/SL1C; 0001-1-2200-2005/SL2; 0001-1-2200-4110/SL3). Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #17: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-52 removing Receiving Officer Joy Naifeh and adding Vicki Martin for the Creek County Election Board (0001-1-2200-1110/SL1A; 0001-1-2200-1130/SL1B; 0001-1-2200-1310/SL1C; 0001-1-2200-2005/SL2; 0001-1-2200-4110/SL3). Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #18: Motion was made by Whitehouse and seconded by Warner to approve Resolution#2023-53 correcting Resolution#2023-36 and Resolution#2023-36A surplussing 1998 Dodge Welding Truck INV#301-0052 Serial number 3B6MC3664WM275290, 1993 Ford with snow plow and blade INV#321-0026 Serial number 1FDYL90E1PVA09955, 2004 Case 850K Dozer INV#321-1005 Serial number CAL004399, 2011 Kubota M108SDSC Tractor INV#304-1027 Serial number 70043 for District #3. Resolution#2023-53A disposing of the same to be sold through Purple Wave.  Whitehouse stated the original resolution listed a 2004 Case 850K Dozer INV#193-323-1005, as a 2008 model. Item #19: Motion was made by Stephens and seconded by Whitehouse to Accept Bid#23-15 Food and Commissary Services for the Creek County Justice Center and pass for two weeks until 5-15-23 to review. Bids submitted by Tiger Correctional, Summit Food Services, and Benchmark. Stephens stated we had two returned bids from Aramark and Swanson Services. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #20: Motion was made by Stephens and seconded by Whitehouse to Deny Bid#23-17 Coping Repair for the Courthouse due to the current bidder's proposed scope of work. Glen Musser, Project Manager presented the current bidder American Central Corporation bid submission. I have made notes where the current scope of work has descriptions with the bid specs. He states that they will need to remove existing coping and there is no existing coping to remove. There are issues with half of the overall price down to start the job, this does not follow the specs. Also, there is possibility of change orders that could increase the current bid price. I really think we need to rebid the project to make sure that we have a solid cost for the repairs. Stephens stated he states the roof needs to be replaced, we have had two engineers inspect the roof and both stated the roof is solid. Item #21: Motion was made by Stephens and seconded by Warner to let for Bid#23-20 Curry Well Rehab/pump, electric and labor for the City of Drumright ARPA Project 1566-5.18-74030-4110, phase I, and REAP Projects #220120 and 210103 to be opened 6-12-23. Stephens stated there is a mandatory pre-bid meeting that will be held on 5/25/23 at 2:00 p.m. located at the Drumright City Hall 424 E. Broadway. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #22: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-54 directing the Creek County Treasurer to credit the General Government M&O account 0001-1-2000-2005/R2 with funds from Westlake Ace Hardware, in the amount of $15.98, as a credit reimbursement, as per Title 62 O.S. § 335, and procedures implemented by the State Auditor's Office. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #23: Motion was made by Warner and seconded by Whitehouse to approve Utility Permit from Oklahoma Natural Gas Company per County Specs for natural gas pipeline by boring, size of line ¾", to cross S. Regency Dr. approximately .84 miles N. & .30 miles E. of US HWY 44 & St HWY 364, further described as 1746' S. of the N.E. corner of Section 13, T18N, R11E in District #2. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #24: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. (1) Motion was made by Stephens and seconded by Warner to receipt and transfer 8 Crowd Control Barriers and 4 Garrett Super Scanners V Metal Detectors that was purchased with ARPA Funds for the Sheriff and Courthouse. We are transferring to the Sheriff Project#1566-1.11-3500-2005, PO#5752. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. (2) Motion was made by Stephens and seconded by Whitehouse to receipt and transfer a Ultra High Sensitivity Walk Through Metal Detector and a Rapiscan 920 DX Multi-voltage that was purchased with ARPA Funds for the Sheriff and Courthouse. We are transferring to the Sheriff Project #1566-1.11-3500-4110, PO#4663. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. (3) Motion was made by Warner and seconded by Whitehouse to approve transfer $246.88 from 1566-1-74030-4110 ARPA Drumright Commissioners FY2022-2023 to 1566-1-74030-2005 ARPA Drumright Commissioners FY2023. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. (4) Motion was made by Whitehouse and seconded by Stephens to approve the use of ARPA Funds for S. 249th W. Ave, two miles, Project#1566-6.1-4300-4110(F), in the amount of $200,266.20, for District #3. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. A motion was made by Whitehouse and seconded by Stephens to approve the use of ARPA Funds for S. 209th W. Ave to W. 131st, one-mile, Project#1566-6.1-4300-4110(G), in the amount of $97,417.10, for District #3. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. A motion was made by Whitehouse and seconded by Stephens to approve the use of ARPA Funds for S. 225th W. Ave between HWY 33 and W. 131st St. S., Project#1566-6.1-4300-4110(H), in the amount of $90,332.22, for District #3. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. A motion was made by Whitehouse and seconded by Stephens to approve the use of ARPA Funds for W. 131st St. S., Project#1566-6.1-4300-4110(I), in the amount of $182,596.68, for District #3. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. A motion was made by Stephens and seconded by Warner to approve the use of ARPA Funds for S. 337th W. Ave and W. 191st St. S off of US HWY 66 1.5 miles, Project#1566-6.1-4100-4110(C), in the amount of $195,588.86 for District #1. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. A motion was made by Stephens and seconded by Warner to approve the use of ARPA Funds for Lonestar Rd two miles, Project#1566-6.1-4100-4110(D), in the amount of $255,959.72, for District #1. Stephens stated this is the first two miles, we have some issues with some flooding that will need to be addressed at some point and rebuild part of the road. We will be raising the areas where it is low, as well. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. Whitehouse and Stephens stated all projects presented will make a big impact to the areas and for the public.
