The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, June 26, 2023 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Newt Stephens, Jr. Roll Call Stephens present, Warner present, Whitehouse present.

Item #2: Statement of compliance with open meetings act-Chairman.

Item #3: Commissioner Stephens led the Pledge of Allegiance and Invocation.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Warner and seconded by Whitehouse to pass for one week until 7-32-23 on regarding Disaster Emergency Proclamation for Creek County, Oklahoma due to storm events beginning June 17, 2023. Stephens stated he has had some difficulties with OG&E and their vegetation control beginning piled up with other debris in the ditches and near the sides of the roads. They have been notified of the burden they are implying on the county and I am not sure if a for profit company can put burden on the county for cleanup of any form. They have refused to come back and remove the debris. I would like to speak with our District Attorney more on this before we move forward. I have also spoken to Todd Hiett and Emergency Management about the issue. This may result in a hearing with the Corporation Commission on this matter. We will revisit this item next week. Item #8: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-75 rezoning request CCZ-2108-Anastasia Beal per recommendations of CCPC. Rezoning from Agricultural District to Residential Manufactured Home District on subject tract to allow one manufactured home. Tract will contain a half-acre more or less. Tract is not located in a flood zone and is surrounded by Agricultural and Light Residential to the west. Tract will meet all requirements. Murray stated Applicant has been made aware of setback lines. We did have a phone call with concerns of the mobile home will be to close to the road and may be located in a flood zone. Mark Seacratt, Flood Plain Manager has provided applicant a letter stating the area is not within a flood zone.  Applicant is present. The CCPC recommended approval on 6-20-23, along with the Planning Office. Property located at 18153 S. 337th W. Avenue Bristow, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #9: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-76 rezoning request CCZ-2109-Cecil Busby per recommendations of CCPC. Rezoning from Agricultural District to Residential Manufactured Home District on subject tract to allow one manufactured home. Tract will contain two lots. Tract is located in a flood zone and is surrounded by Agricultural, city of Tulsa and Industrial to the west. Tract will meet all requirements. There has been no opposition. Applicant is present. The CCPC recommended approval on 6/20/23, along with the Planning Office. Property located at 6933 W. 62bd St. S. Tulsa, OK-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #10: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-77 rezoning request CCZ-2110 and lot split CCLS-2902-Dow Bushyhead per recommendations of CCPC. Rezoning from Agricultural District to Light Residential District to allow a lot split resulting into Tracts 1, 2, and 3, Tract 1 will contain 2.9 acres more or less. Tract 2 will contain 2.28 acres more or less and Tract 3 will contain 2.28 acres more or less. Tracts will meet all requirements. The tracts are surrounded by City, Agricultural and Light Residential. Applicant is present. The CCPC recommended approval on 6/20/23, along with the Planning Office. Property located S. of Keystone Loop on Basin Rd. Mannford, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #11: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-78 rezoning request CCZ-2112 and lot split CCLS-2905-Dustin Lousch per recommendations of CCPC. Rezoning from Agricultural District to Light Residential on subject tract to allow lot split. Tract 1 will contain 2.07 acres more or less. Tract 2 will contain 2.80 acres more or less. The property was rezoned in 2021 into two 2.5-acre tracts, there has been some issues with utilities and the electric pole, along with the septic location. The tracts are surrounded by Agricultural Districts. Applicant is not present. The CCPC recommended approval on 6/20/23, along with the Planning Office. Property located at 22018 W. Cedar Lane Sapulpa, OK 74066.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #12: Motion was made by Warner and seconded by Whitehouse to sign the Creek County Treasurer's Financial Statement for fiscal year 2023-2024. Teresa Whisenhut, Acting-Tresurer stated we left it basically the same as last year. Creek County Treasurer's Financial Statement for fiscal year 2022-2023. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #13: Motion was made by Warner and seconded by Whitehouse to deny Bid#23-19 Lease Purchase of One or More New or Demo Custom Cab Pumpers for Drumright Fire Department per recommendation of Brett Lunsford. Lunsford stated that with inflation and the rise in the current interest rates, it would be the best for the citizens that we deny the bid. We have to be good stewards of the county money and we do not think right now is the right time. We have reviewed other options with more affordable prices. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #14: Motion was made by Stephens and seconded by Whitehouse to let for Bid#23-28 One or More 2015 or Newer Track Mounted Compact Crushers to be opened 7/10/23. Stephens stated he has waited until March to see the machine and now I have. I believe it would be very beneficial for District 1 and it will pay for itself within two years. We will be able to save on rock costs. Jana Thomas, Purchasing Agent reminded Stephens to provide additional vendors. Thomas stated I have googled some from the internet, but we need more. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #15: Motion was made by Stephens and seconded by Warner to sign Resolution#2023-79 directing the Creek County Treasurer to credit the Creek County General Government Insurance Account 0001-1-2300-1222/R4 with funds from Benefit Resources, Inc., in the amount of $773.24, as per 62 O.S. § 335, and procedures implemented by the State Auditor's Office. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #16: Motion was made by Warner and seconded by Whitehouse to approve Utility Permit from Oklahoma Natural Gas Company per County Specs for natural gas pipeline, by boring, size of line ¾", to cross N. Walnut Drive approximately 3.30 miles N. & 0.26 Miles E. of Jct. SH 97 & SH 166, further described as 1,716' S. & 2,525' N. of the S.E. corner of Section 2, T18N, R11E in District #2. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #17: Motion was made by Whitehouse and seconded by Warner to approve Utility Permit from East Central Electric Cooperative per County Specs for fiber optic plant by boring and trenching, size of line 1 ¼", to cross Windmill Rd south of W. 311th St. S. in Section 9, T14N, R7E in District #3. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #18: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. (1) Motion was made by Stephens and seconded by Whitehouse to award Bid#23-20 Curry Well Rehab/Pump Electric and Labor for the City of Drumright ARPA Project #1566-5.18-74030-4110 phase I and REAP Projects #220120 & 210103 to Smith Pump and Well Service, dba Smith Pump Enterprises LLC that was approved by the City of Drumright on 6/20/23, ARPA Project 1566-5.18-74030-4110. Stephens stated last week we awarded based upon the contingency for approval from the city and we needed to clarify the bidders company name. Stephens stated they are registered in SAMS.GOV with the Smith Pump Enterprises LLC. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. (2) Motion was made by Stephens and seconded by Whitehouse to approve the use of ARPA Funds for W. 106th from 161st St. W. to 177th, W. 106th from 161st St. from 177th to 193rd, Pelican Point Place portion of Saltcreek Rd to E0630 Rd., W. 41st, W. 51st  one mile from Kennyville Rd to HWY 48, W. 51st one mile from S. 369th to 385th, Old HWY 51 five areas, S. 449th W. Ave one patch, 161st west ace S. from 106th ½ mile Project in District #2, Project#1566-6.1-4200-4110(K), in the amount of $773,217.00, we have about $105,574.00 that will be paid from our highway funds to complete the project. Warner stated there are nine projects that will all tie into each other and are apart of our major collectors. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.
