The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Tuesday, September 05, 2023 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Stephens. Roll Call Stephens present, Warner present, Whitehouse present.

Item #2: Statement of compliance with open meetings act-Chairman.

Item #3: Commissioner Stephens led the Pledge of Allegiance and Invocation.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Warner and seconded by Whitehouse to adopt Resolution#2023-141 approving the incurrence of indebtedness by Creek County Education Facilities Authority (the "Authority") issuing its Lease Revenue Bonds, Series 2023 (Drumright Public Schools Project); providing that the organizational document creating the Authority is subject to the provisions of the Indenture of Trust, authorizing the issuance of said Bonds; waiving competitive bidding and approving the proceedings of the Authority pertaining to the sale of said Bonds; and containing other provisions relating thereto. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #8: DISCUSSION ONLY/NO ACTION to consider allowing the Ladies of Liberty to use the Commissioners' Meeting room to host a speaking engagement regarding the 30 x 30 Land Grab on September 11, 2023, from 11:30 a.m. to 1:30 p.m.-Dee Dobson, Ladies of Liberty. Dobson spoke to the Board about the 30 x 30 Land Grab our Governor has signed a Resolution stating that Oklahoma is not participating in this and we would like the Board to sign a resolution as well stating Creek County will not be participating in it either. On January 27, 2021 the President signed an Executive Order #14008, know as 30 x 30 Land Grab. It will affect over 7 million people across the country, this would allow them to take your land and would affect Farmers, Ranchers, Oil and Gas Owners and Property Owners, as well. We would like to educate the Commissioners and Creek County on what this could do to our town. Dobson stated they had this booked at First United Bank and they have canceled on us.  We have Angel Cushing, Guest Speaker coming in from Kansas to speak to the citizens. We have invited our legislators, as well as the public to attend. We would like to ask if we could utilize this room to host the meeting.  Stephens stated we have statutory duties to conduct county business on Monday's and we do not know what next weeks agenda will look like or how long the meeting may take. There was discussion of other venues that could be utilized to conduct the meeting, such as the Fairgrounds and Sapulpa Library. There was also discussion that the room can only hold 49 people, per the fire marshal.  Warner stated that this is a public building and we would like to have things in the evening that way it does not disrupt county business during the day. There was discussion of if they could move the meeting to the evening. Dana Logsdon, Deputy Commissioner was asked to contact the Fairgrounds to see if the facility was available. The Board reported the cost would be $350.00 to rent the space. Dobson stated we do not have the money. Charles Betzler contact the Sapulpa Library and they agreed to allow the meeting to take place there. Dobson asked for future knowledge does the county allow the use of the meeting room for the public. Warner stated yes, this is a public building.

Item #9: Motion was made by Warner and seconded by Whitehouse to approve the Financial Statement and Estimate of Needs for Creek County for fiscal year 2023-2024, in the amount of $9,585,620.24. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #10: Motion was made by Stephens and seconded by Whitehouse to approve engaging with the State Auditor and Inspector for an audit of the Treasurer's Office pursuant to 19 O.S. § 171(E), at the request of incoming Treasurer, Rick Engleman. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #11: Motion was made by Stephens and seconded by Warner to accept Bid#24-5 3 Month Asphalt and Emulsion Products and Professional Services and pass for one week until 9-11-23 to award. Bids submitted by Apac Central Inc., Coastal Energy Corp., Vance Brothers Inc., Dunhams Asphalt Services Inc., Tulsa Asphalt LLC, Ergon Asphalt & Emulsions Inc., Millenial Asphalt, Wright Asphalt Products Co., Logan County Asphalt. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #12: Motion was made by Stephens and seconded by Warner to award Bid#24-4 Purchase 5 or More Refurbished 800mhz Handheld Portable Radios for the Sheriff's Office per the recommendation of Joe Thompson, Under-Sheriff, to BTM Wireless Inc. Thompson stated they were the cheapest, they are the exact model and make of the existing and our chargers would work as well. We had another vendor that offered a different style that would require new chargers and additional training. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #13: Motion was made by Stephens and seconded by Whitehouse to award Project#D2 21-9/5/23 Equipment Shed Bay Enclosure, the addition to District #2 County Barn to Moorehead Construction, in the amount of $21,400.00 and allow Warner to sign the contract. Warner stated we originally went out for bid on this project; we did not receive any bids. So, this is our second go around to enclose the bay, we sent out the specs and got two responses. Moorehead was the lowest and RD Simpson was a bit more at $29,500.00. We did not get the electrical in the bid specs, so we will do that ourselves. Jana Thomas, Purchasing Agent stated we sent this out to five bidders, we received two bids back and three no bids. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #14: Motion was made by Stephens and seconded by Whitehouse to approve the Independent Contractor Agreement for Carol Parrett, dba Dirt Road Data, for the 2023-2024 fiscal years for the Creek County Assessor striking the word minimum and adding up to 12,750 residential property appraisal records, at $9.00 per appraisal. Haley Anderson, Assessor stated this is for our data entry of residential. The vendor is accredited and this will ensure the data entry to be done in a timely manner and up to OTC standards. Anderson stated we do not have enough manpower currently in office to do this entry. We will be doing the Commercial in house. There was discussion of if this item required a bidding process. Thomas stated it is exempt due to being a service and no materials are needed. Andrew Goforth, Assistant District Attorney has reviewed this stated Thomas. Stephens asked what other county has this company done business with. Anderson stated Muskogee County and one more. They did our Business Personal data entry last year, as well. They are trained in all areas and it would be faster, they are located in Nowata County. The Board stated this would be obligating roughly $115,000.00, this year. Anderson stated it was figured into our current budget. Thomas stated the Assessor utilized this company last year and this would basically be renewing a new contract for this fiscal year. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #15: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-107A disposing of a 2000 International Fuel Truck INV#192-302-0029 VIN#IHTSCABMOYH255916 sold to Alex Portillo via Purple Wave, in the amount of $5,600.00.  Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. A motion was made by Warner and seconded by Whitehouse to sign Resolution#2023-142 correcting Resolution#2023-133A disposing of a 2001 Chevrolet One Ton Dually VIN#IGCJC39G21E323550 transferring it back to the Creek County Sheriff's Office, as this item cannot be transferred to another department due to being a forfeiture seized vehicle. Warner stated legal got involved after the transfer and it was stated that the vehicle has to be sold to follow the law. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #16: Motion was made by Stephens and seconded by Warner to sign Resolution#2023-143 surplussing a LD 122 Scanner/Printer/Copier INV#H01.036 Serial Number J8355501724, Lexmark Copier INV#P01-04 Serial Number G3995 and a Receptionist Desk INV#H19.10 and Resolution#2023-143A disposing of the same printer and Scanner combo to be junked and the Receptionist Desk to be transferred Commissioners Office. Anderson stated that they are cleaning up the inventory. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #17: Motion was made by Stephens and seconded by Warner to sign Resolution#2023-144 surplussing a 2017 Dodge Charger with attached equipment, Metal Console, Jotto Desk Gun Lock and Go Rhino Push INV#0831, 17-831 VIN#2C3CDXKT1HH624046, bar with emergency lights, Streamlight Flashlight and Charger, Unbranded Transport Partion and Fenix Light and Siern Control Box, Stalker Radar INV#0915 Serial Number EC006622 and 2017 Dodge Charger with attached equipment, Metal Console, Jotto Desk Gun Lock and Go Rhino Push INV#0832, 17-832 VIN#2C3CDXKT3HH624047, bar with emergency lights, Streamlight Flashlight and Charger, Unbranded Transport Partion and Fenix Light and Siern Control Box, Stalker Radar INV#0914 Serial Number EC006621 for the Sheriff's Office and Resolution#2023-144A disposing of the same to be transferred by Inter-Governmental Transfer to Mannford Police Department. Item #18: Motion was made by Stephens and seconded by Whitehouse to sign Resolution#2023-145 removing Receiving Officer Lynn Wick and adding Angela Holladay for the Creek County Clerk's Office Accounts (0001-1-1000-1110/F1A; 0001-1-1000-1320/F1C; 0001-1-1000-2005/F2; 0001-1-1000-4110/F3; 1208-1-1000-2005/CCLF1; 1209-1-1000-1130/CCPF1; 1209-1-1000-2005/CCPF1). Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #19: Motion was made by Stephens and seconded by Whitehouse to sign Resolution#2023-146 removing Receiving Officer Amy Quinn and adding Lynn Clark for the Creek County Highway District #2 Accounts (1102-6-4200-1110/T1A; 1102-6-4200-1320/T1C-2; 1102-6-4200-2005/T2-2; 1102-6-4200-4110/T3-2; 1102-6-6500-2005; 1102-6-6520-2005; 1313-6-8042-2005/HTX2-2; 1313-6-8042-4110/HTX3; 1103-6-4200-4030/CBI2; 1103-6-4000-4030/CBIA) noting Scribner's Error on Agenda stating Lynn Wick. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #20: Motion was made by Stephens and seconded by Whitehouse to approve Schedule of Expenditures of Federal Awards to be submitted to the Oklahoma State Auditor's Office, for Fiscal Year's ending 2021, 2022, and 2023. Tandra McClellan, Payroll Deputy stated these are recommended changes due to the Sheriff reporting unallowed expenditures for matching, work-comp, and benefits in the expenditures category. This is not allowed by the grant language. Mortazavi stated Logsdon and the Sheriff's Office had worked on the corrections and the Clerk's Office was not involved.  Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #21: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2023-147 adding Barbara Woodard, as a replacement for the Creek County Ambulance Board. Whitehouse stated Jorge, with Creek County Ambulance contacted him with a recommendation. This is a replacement from the resignation of John Conklin. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #22: DISCUSSION ONLY/NO ACTION to consider a replacement for the Creek County Excise Board. Stephens stated he has a couple of recommendations that has been given to him Steve McCormick Sr. and Larry Hoover. Mortazavi asked is either one on the Sapulpa Public School Board, Stephens stated Hoover currently is. Warner stated he would like to recommend Bradd Bingman. Warner asked if either McCormick or Hoover had land experience. Stephens stated McCormick has been in the banking industry and a realtor.

Item #23: Motion was made by Whitehouse and seconded by Warner to approve the renewal of the Inter-Cooperative Agreement with Bristow Fire Department for District #2. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. The contract with Oklahoma Office of Juvenile Affairs Detention Transportation Contract was passed until 9-11-23 for review of language of reimbursements.

Item #24: Motion was made by Stephens and seconded by Warner to approve Utility Permit from TDS Telecom per County Specs for fiber optic cable by boring, plowing and aerial, to cross and parallel S. 49th W. Ave approximately 0.3 miles S. of W. 181st St. S., further described as 1400' N. of the S.E. corner of Section 5, T16N, R12E in District #1. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #25: DISCUSSION ONLY/NO ACTION on updating the Creek County Handbook. Mortazavi stated with the late additions sent over from Goforth on the Accountable Travel Plan and amendments to some of the language from conversations with Sheriff and Treasurer can we pass this out until 9-11-23, to allow time for everyone to review.   

Item #26: DISCUSSION ONLY/NO ACTION to consider sending a letter of intent to pursue an opioid abatement grant from Oklahoma Opioid Abatement Board. Warner stated Attorney General Drummond sent out a letter last week that stated counties can go after some of the monies that was set aside for the State of Oklahoma. I would like to submit a letter and utilize the monies for rehab purposes.

Item #27: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. No update at this time. (1) No Road or Bridge projects at this time.
