The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, August 25, 2025 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Stephens. Roll Call Stephens present, Moore present, Whitehouse present.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-118 rezoning request CCZ-2174 and lot split CCLS-3064-Allen and Sara Galloway per recommendations of CCPC. Rezoning from Agricultural District to Light Residential District to allow lot-split. Tract 1 will contain 1.25 acres more or less and meet all requirements of Light Residential District. Tract 2 will contain 1.25 acres more or less and meet all requirements of Light Residential with CCBOA-535. This tract has access from a non-county-maintained road. There has been no opposition. Applicant is present. The CCPC recommended approval on 8-19-25, along with the Planning Office. Property is located at 6541 S. 161st W. Avenue Sapulpa, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #8: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-119 rezoning request CCZ-2175 and lot split CCLS-3066-Troy Belk per recommendations of CCPC. Rezoning from Agricultural District to Light Residential to allow lot split. Tract 1 will contain ½ acre more or less and meet all requirements of Light Residential District. Tract 2 will contain 9.50 acres more or less and meet all requirements of Agricultural District, when tied to the tract to the west. Property is surrounded by Agricultural. There has been no opposition. Applicant is present. The CCPC recommended approval on 8-19-25, along with the Planning Office. Stephens asked if anyone would like to speak, Roosevelt Roston resident near was concerned with property values. Will this increase or decrease the property values. Murray stated this is for one residential home to be built, not a mobile home or tiny home can be put on the tract. This will be for his sister and nephew. Stephens stated it will be a good stick built home and good for the area. Property is located at 14275 S. 177th W. Avenue Kellyville, OK.-Wendy Murray, Planner. Item #9: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-120 rezoning request CCZ-2176 and lot split CCLS-3067-Troy Belk per recommendations of CCPC. Rezoning from Agricultural District to Light Residential to allow lot split. Tract 1 will contain .72 acre more or less and meet all requirements of Light Residential District. Tract 2 will contain 9.28 acres more or less and meet all requirements of Agricultural District. Tract is surrounded by Agricultural and Town of Kellyville. There has been no opposition. Applicant is present. The CCPC recommended approval on 8-19-25, along with the Planning Office. Property is located at 17262 W. 141st St. S. Kellyville, OK.-Wendy Murray, Planner. Item #10: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-121 rezoning request CCZ-2177 and lot split CCLS-3068-Tyler Walesch per recommendations of CCPC. Rezoning from Agricultural District to Light Residential District to allow lot split. Tract 1 will contain 12.65 acres more or less and meet all requirements of Light Residential District. Tract 2 will contain 1.65 acres more or less and remain Agricultural District. Tract is surrounded by Agricultural, Light Residential, and city. There has been no opposition. Applicant is present. The CCPC recommended approval on 8-19-25, along with the Planning Office. Property is located at 23288 Country Club Drive Bristow, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #11: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-122 rezoning request CCZ-2160 and lot split CCLS-3069-Landon Sloan per recommendations of CCPC. Rezoning from Agricultural District to Commercial District to allow lot split to allow used farm equipment sales. Tract 1 will contain 1.975 acres more or less and meet all requirements of Commercial District. Tract 2 will contain 44.77 acres and remain Agricultural. Tract is surrounded to the north by Agricultural, east and south Agricultural, west Residential Manufactured Home District. Murray stated that the Planning Commission and Applicant agreed to conditions stated in the resolution that if the property is sold or business closes, they would rezone it back to Agricultural use. Murray presented an email sent by Marsha Hayes asking for a special use permit instead of a permanent rezoning. Stephens stated this falls in line with the conditions listed on the resolution. She is not against the rezone; she just wants to protect the land for future use. Whitehouse asked again if the applicant agreed with the terms. Murray, stated yes. Applicant is present. The CCPC recommended approval on 8-19-25, with conditions along with the Planning Office. Property is located at 2503 W. HWY 48 Mannford, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #12: Motion was made by Stephens and seconded by Whitehouse to send the item back to the Planning Commission on discussion and possible action to consider rezoning/lot split cases CCZ-2178 and CCLS-3070; applicant, Tanner Consulting, requests approval of rezoning from Agricultural to Light Residential District on tract 1 and 2 to allow a lot-split located at 6655 Riva Ridge Road, Tulsa. Murray stated this is a rezoning request to rezone from Agricultural to Light Residential District. Tract 1 will contain 2.74 acres more or less and meet all requirements of Light Residential. Tract 2 will contain 16.62 and meet all requirements of Light Residential. Tract is surrounded by Agricultural and Light Residential. The Applicant is present. The CCPC recommended approval on 8-19-25, along with the Planning Office. Stephens addressed the uniqueness of this property with the potential use being a subdivision, I would recommend that this is sent back to the Planning and Zoning Commission. The 2.74 acres meet the zoning requirements. However, the 16.62 does not fit the requirements. This is Agricultural, per the HOA Bylaws it must be approved by them before it comes to this Board. We have consulted with legal; you are good on the 2.74 acres that is a normal one. The 16.62 doesn't fit the regulations as presented. I think it needs to go back to the CCPC where you can submit a plan with the application. Instead of not having a plan to present and you just saying this may happen. Andrew Shanks, Attorney for landowner spoke briefly with the Board about the CCPC recommending approval and the Planning Office recommending approval as well. The 16.62 acres is currently in litigation to determine what covenants will govern that parcel. This is the first step in the process, is to get this rezoned, then the platting process would begin. We need the rezoning to be approved to move forward. Shanks suggested tabling the item until the next meeting to discuss. Stephens stated I would be more prone to send it back to CCPC to be heard on the September 16, 2025 meeting where you can submit the plan and be within the regulations. Shanks asked if the plan Stephen's was referring to is the Preliminary Plat, Stephens stated yes. This way we have a clear idea of what's going to happen. It is would give a clear and transparent future plan for the 16.62-acre tract. Shanks stated his client was following the current regulations, that he would take this back to his client and will be prepared for the next meeting. Charles Wilkins, Foxbriar at the Oaks counsel, stated that the recommended process would be appropriate and he agreed with the Board. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #13: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-123 setting a Public Hearing to be held on September 22, 2025 on the merits and sending and publishing notice for the same for the county to maintain a road described as S. 215th W. Avenue in Section 10, T17N, R10E in District #3. Whitehouse stated this is S. of HWY 33 and has about 15 homes that I think is in the best interest for the county to take the road into the county system. The time frame was discussed, along with the three publication requirements, and notices to be mailed out. Stephens asked who would be paying for the publication and notices, Whitehouse stated D3. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #14: Motion was made by Whitehouse and seconded by Moore to approve the following Contracts for 2025-2026 fiscal year: Rogers County Juvenile Detention Contract and Seminole County Detention Contract, Sheriff. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #15: Motion was made by Whitehouse and seconded by Moore to let for Bid#26-2 3 Month Asphalt and Emulsions Products and Services to be opened on 9-8-25. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #16: Motion was made by Stephens and seconded by Moore to approve the Schedule of Expenditures of Federal Awards to be submitted to the Oklahoma State Auditor's Office. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #17: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-124 surplussing HP Laser Printer INV#610.37, Check Scanner INV#31.319, Laser Printer INV#610.33, Slip Printer Val INV#610.343, Slip Printer VAL INV#610.346, Electric # Machine INV#233.003, Epson Slip Printer VAL INV#610.081, Epson Slip Printer VAL INV#610.215, Slip Printer VAL INV#610.245, Slip Printer VAL INV#610.246, and Check Scanner INV#610.312 for the Treasurer's Office and Resolution#2025-124A disposing of the same to be junked. Item #18: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-125 directing the Creek County Treasurer to credit the General Government Other Insurance Account 0001-1-2000-2066 with $1,000.00 from the Creek County Industrial Authority as reimbursement for liability insurance coverage, as per Title 62 O.S. 335, and procedures implement by the State Auditor's Office. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #19: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-126 adding Requisitioning Officers Max, Cook, Andrew Goforth and Isaac Shields for the District Attorney's Office M&O account (0001-1-0200-2005/A2), removing Requisitioning Officer Kelly Hake and adding Andrew Goforth on the Drug Court M&O account (7206-1-0100-2005/DC96), and removing Requisitioning Officer Maryann Hon and adding Andrew Goforth on the Mental Health Court M&O account (7207-1-0100-1110, 7207-1-0100-2005). Item #20: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-127 adding Receiving Officers Kim Hight and Mitzi Gregory for the District Attorney's M&O account (0001-1-0200-2005/A2), removing Receiving Officer Andrew Goforth and adding Mitzi Gregory on the District Attorney's Drug Court M&O account (7206-1-0100-2005/DC96), and removing Receiving Officer Andrew Goforth and adding Mitzi Gregory on the District Attorney's Mental Health Court M&O accounts (7207-1-0100-1110; 7207-1-0100-2005). Item #22: Motion was made by Stephens and seconded by Whitehouse to approve Utility Permit from ONEOK Gas Transportation LLC per County Specs for pipeline, by boring, size of line 24"-0.375 wall thickness, ARO-X-65/Steel, to cross W. 161st St. S. approximately 0.16 miles W. of W. 161st St. S. & Slick Rd Intersection, further described as 830.6' W. of S.E. corner of Section 22, T17N, R10E in District #1. Item #23: Motion was made by Whitehouse and seconded by Moore to approve Utility Permit from East Central Electric Cooperative per County Specs for fiber optic plant by boring and trenching, size of line 1 ¼", cross and parallel S. 289th W. Avenue south of south 289th W. Avenue and W. 231st St. Street Jct. in District #3. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #24: Motion was made by Whitehouse and seconded by Moore to approve Utility Permit from East Central Electric Cooperative per County Specs extending from 30-days to 90-days for fiber optic plant, by boring and trenching, size of line 1 ¼" to cross and parallel multiple locations from S. 321st W. Avenue, starting south of HWY 16 and traveling to HWY 48 in District #3. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #25: Motion was made by Moore and seconded by Whitehouse to approve Utility Permit from Cimarron Telephone Company per County Specs for fiber optic communication line by boring and trenching, size of line up to 288 microfiber, size of casing 3-way 1.25" duct & 2-way 18 mm duct, to cross and parallel S. 193rd W. Ave, W. 101st W. Ave, S. Pinehill Rd., and W. Cedar Lane approximately at the intersection of W. 106th St. S., further described as 1,400' N. of the S.E. corner of Section 26, T18N, R10E in District #2. Item #26: Motion was made by Moore and seconded by Whitehouse to approve Utility Permit from Cimarron Telephone Company per County Specs extending from 30-days to 90-days for fiber optic communications line by boring and trenching, size of line up to 144 microfiber, size of casing 4-way 14-18mm micro-duct to cross and parallel several roads at the junction of W. 106th St. S. in District #2. Item #27: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. None at this time.
