The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, September 22, 2025 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Stephens. Roll Call Stephens present, Moore present, Whitehouse present.

Item #2: Statement of compliance with open meetings act-Chairman.

Item #3: Commissioner Moore led the Pledge of Allegiance and Invocation led by Whitehouse.

Item #6: DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.) Stephens stated the Public Hearing scheduled for 9/22/25 has been postponed to 10-14-25 S. 215th W. Avenue, District #3. This will be republished and notices will be remailed.

Item #7: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-138 rezoning request CCZ-2179-Mark Oatman per recommendations of CCPC. Rezoning from Agricultural District to Commercial to allow camping/RV store. Tract will contain 3.85 acres more or less and meet all requirements of Commercial District. Tract is surrounded by Agricultural, to the north, south, and west and Commercial to the east. Murray stated this will be a family owned and operated. There has been no opposition or comments. Applicant is present. The CCPC recommended approval on 9-16-25, along with the Planning Office. Property is located at 25751 W. HWY 66, Kellyville, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #8: Motion was made by Moore and seconded by Whitehouse to sign Resolution#2025-139 rezoning request CCZ-2180 and lot split CCLS-3078-T-Squared Inc. per recommendations of CCPC. Rezoning from Agricultural District to Light Residential District to allow lot split. Tract 1 will contain 1.42 acres more or less and meet all requirements of Light Residential District. Tract 2 will contain 1.09 acres more or less and meet all requirements of Light Residential District. Murray stated there is an existing home that will be on one tract and they are wanting to build on the additional tract. There has been no opposition. Applicant is not present. The CCPC recommended approval on 9-16-25, along with the Planning Office. Property located at 7891 S. HWY 97 Sapulpa, OK 74066.-Wendy Murray, Planner.  Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #9: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-140 rezoning request CCZ-2181 and lot split CCLS-3078-Cory Miller per recommendations of CCPC. Rezoning from Agricultural District to Light Residential District to allow lot split. Tract 1 will contain 1.0 acres more or less and meet all requirements of Light Residential District. Tract 2 will contain 9.0 acres and remain Agricultural District. Tracts are surround by Agricultural District. They are not located within a flood zone. There has been no opposition. Applicant is present. The CCPC recommended approval on 9-16-25, along with the Planning Office. Property is located at 20933 W. Hickory Drive Sapulpa, OK 74066.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #10: Motion was made by Stephens and seconded by Whitehouse to sign Resolution#2025-141 rezoning request CCZ-2178 and lot split CCLS-3070-Tanner Consulting per recommendations of CCPC. Tract 1 will contain 2.744 acres more or less and meet all requirements of Light Residential District. Tract 2 will contain 16.626 acres more or less and meet all requirements of Light Residential District. Applicant is present. The CCPC recommended approval on 9-16-25, along with the Planning Office. Property located at 6655 Riva Ridge Road Tulsa, OK.-Wendy Murray Planner. Charles Wilkins, Attorney and Resident spoke to the Board asking for this item to be tabled until next month when the ruling from the Judge will be completed. Andrew Shanks, Attorney for landowner spoke briefly to the Board and presented a conceptual site plan, this was also presented to the CCPC. The Planning Commission also approved the rezoning request, along with the Planning Office staff report. We have complied with what was requested by the Board at the previous meeting. The Preliminary Plat will come later. We will have 13 lots on the 16 acres; they will be 1-acre tracts. These tracts will contain 3500 sq foot homes and will comply with all architectural guidelines. The applicant requests for approval of what is before you today. The HOA Board has to wait on the Judge to say what portion of the convenances must be followed. This is a pre-curser, the staff has stated it fits the comprehensive plan, meets the zoning requirements, they are the same as the Foxbriar, we ask that you approve the Light Residential use. Stephens spoke about his involvement in 2011 Foxbriar mess, with roads not built in proper places, I fought for the protection of the residents. This was my main concern when this came before the Board last month. What has been presented today fits the area, it is a good fit in my opinion and meets our regulations. Moving forward the convenance will be determined by the Judge and that is not our decision. You have carried out your intent for the addition, I know there will be some changes when you start the process with the contour of the land. Wilkins addressed the Board again, and spoke briefly about the 2011 lawsuit that he was a part of. There was a lot of people that paid premium prices for a polo field that know will no longer be there. We ask that you wait until the Judge renders an opinion on the HOA language. Stephens stated what is approved here today does not override the Judge. There is no rush to dig up dirt today. It meets our requirements; it does fit the area. If the Judge rules in ten days and it changes what is done here today, they will have to come back before us. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #11: Motion was made by Stephens and seconded by Moore to award Bid#26-2 3-Month Asphalt and Emulsions Products and Services per District. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #12: Motion was made by Stephens and seconded by Whitehouse to give the authority to the District Attorney's Office to join the two new National Opioid Settlements: Purdue and Secondary Manufacturers Direct Settlement and start establishing the sub-accounts. Andrew Goforth, Assistant District Attorney spoke to the Board, we have received a request to join the two new settlements. This is local funds and not state funds, there is no current value at this time. We will know later in October when the joining of settlement closes. We will need to create two new sub-accounts and necessary expenditures accounts. Mortazavi stated the creation of account is done through resolutions, so we will need to get those prepared and submitted. Also, do we know how the funds can be spent. Goforth stated they will follow the same approved expenditures as the other opioid funds that Brad Barron finalized. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #13: Motion was made by Whitehouse and seconded by Moore to approve the following contracts for 2025-2026 fiscal year Central Technology Center Gun Range Usage Agreement with District #1. Stephens stated he is excited to see different entities utilizing the new facility. All scheduling is through Karen Smith, Secretary. Stephens encouraged other entities to utilize the facility as well. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #14: Motion was made by Moore and seconded by Whitehouse to approve extension of REAP Contract 230221 Asphalt Overlay on W. 61st St. S. (Oakhurst) and authorize the Chairman to sign, in the amount of $103,100.00, funding period January 5, 2023 extended from September 30, 2024 to September 30, 2026. Moore stated he was unaware of this grant and needed to extend to complete project. Mortazavi asked if this is one that Warner was approved for, Moore stated yes. And your secretary wasn't aware of this grant either. Moore stated no. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #15: Motion was made by Moore and seconded by Whitehouse to approve extension of REAP Contract 240224 Repaving 9 blocks of S. 65th W. Avenue (Oakhurst) and authorize Chairman to sign, in the amount of $150,000.00, funding period January 19, 2024 to September 30, 2026. Moore stated this is the same as the previous agenda item.  Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #16: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-142 removing Receiving Officers Joseph Fisther and Bryan Deshazo and adding Wade Snelling and Steven Marlow for Bristow Volunteer Fire Department Accounts 1321-2-8200-2005 and 1321-2-8200-4110. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #17: Motion was made by Moore and seconded by Whitehouse to approve Utility Permit from ONE Gas Inc./Oklahoma Natural Gas Company per County Specs for natural gas pipeline by boring, size of line 3-4" to cross W. 71st St. S. approximately W. of Jct. U.S. 44 & U.S. 75, further described as 671' W. of the N.E. corner of Section 9, T18N, R12E in District #2. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #18: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. Jana Thomas, Purchasing Agent updated the Board on the Jail Water Control System and Town of Oilton Water/Sewer Project. They should be out this week for final trouble shooting for the Jail Control System. Town of Oilton just paid $107,000.00 of their project. We still have Turn Key and Guy Engineering outstanding. But we are making process to complete projects.
