April 21, 2025

The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, April 21, 2025 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Stephens. Roll Call Stephens present, Moore present, Whitehouse present.

Item #2: Statement of compliance with open meetings act-Chairman.

Item #3: Commissioner Moore led the Pledge of Allegiance and Invocation led by Whitehouse.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: DISCUSSION ONLY/NO ACTION on presentation of Opioid Abatement Grant with Family and Children's Services, Human Skills and Resources, Creek County Youth Services, CREOKS, Creek County Health Department, and LifeGate regarding the opioid abatement settlement grant administered by the Oklahoma Attorney General's Office. Ashley Ridge, CREOKS Representative updated the Board on the progress for the fourth quarter reporting. I would like to leave you with the draft of the new implementation plan for the next application process to review. The opening of the new request will be May 11, 2025 through June 12, 2025. I would like to get your feedback on the new plan and then come and give a final presentation and request for submitting the second application on June 12. Ridge stated let's get started with the updates from entities. CREOKS has exceeded their goal, we have assisted twenty-one individuals with housing assistance. Our initial plan was for twenty. We will utilize all funding requested and be evaluating our needs with the next request increasing our funding. We have also conducted a poll with individuals thirty days and ninety days after assistance, we have see decreased substance abuse and an increase in engagement agreements, and they were able to receive medication assistance to maintain sobriety. Also, my position was part of the funding requested and there will be funding for my position into September. Family Children's Services has launched their GED and Parenting Classes within the Jail, in March and April. We have twenty-four currently enrolled for GED. We did experience some challenges with limited space in the jail and operation hours, but some of this has since been resolved. Our goal is to provide effective time management to offer the classes. We will also have some funding to roll over into the next year. Human Skills and Resources has helped twenty-five individuals last quarter, they will also stay within budget. LifeGate has been able to offer twenty-five scholarships and have had recipients remain sober. They will be on track as well for the end of the year. Youth Services of Creek County has had the most challenges. They have received curriculum for parenting and opioid use. We are hoping to have this service implemented late April. Ridge asked the Board if they have any questions. Mortazavi asked after reviewing your implementation plan for next submission am I missing Youth Services request. Ridge stated that they have decided not to submit this next application process, since they have yet to utilize their funds currently. Also, will LifeGate being utilizing any of the additional funding on the new women's facility. Ridge stated no, this will only be for the one location. The women's facility has different source of funding they are looking at. Mortazavi asked how many can LifeGate provide housing for, Ridge stated she was not sure, but could get the numbers at a later time. Mortazavi also asked if the updated expansion of uses for the funds had been released. Ridge stated that she thinks that all uses are available currently in exhibit "e" and is not sure if they have been updated per the last Attorney Generals meeting. Stephens inquired about Youth Services and the Health Department. Ridge updated Stephens on Youth Services and stated that they will reach out to the Health Department and see if they would like to be included in request. The Board and Ridge discussed submitting new application for only one year of funding to allow others to be able to join in request. Ridge stated she will be back on June 12, with an additional presentation and request for approval of submitting the second application.

Item #8: Motion was made by Stephens and seconded by Whitehouse to let for Bid#25-14 Commonly Used Items to be opened 5-12-25 and awarded on 6-9-25. Vote as follows: Stephens- Aye, Moore - Aye, Whitehouse - Aye.

Item #9: Motion was made by Whitehouse and seconded by Moore for the Allocation of Beverage Tax to be distributed as follows Bristow $2,941.48; Depew $284.59; Drumright $1,772.65; Kellyville $705.60; Kiefer $1,514.37; Lawrence Creek $83.79; Mannford $2,58.74; Mounds $645.35; Oilton $612.81; Sapulpa $15,184.51; Slick $104.56. Vote as follows: Stephens- Aye, Moore - Aye, Whitehouse - Aye.

Item #10: Motion was made by Whitehouse and seconded by Moore to approve Utility Permit from ONE Gas Inc per County Specs for ¾" natural gas pipeline by boring, size of line ¾", to cross W. 91st St. approximately 0.96 miles W. & 0.78 miles of Jct. SH 97 & SH 166, further described as 2,277' E. of the N.W. corner of Section 22, T18N, R11E in District #3.  Vote as follows: Stephens- Aye, Moore - Aye, Whitehouse - Aye.

Item #11: Motion was made by Moore and seconded by Whitehouse to approve Utility Permit from FiberLink LLC per County Specs for 2 fiber ducts conduit, size of line ¾", size of casing 1.5" ducts, to parallel and cross W. 81st St S. starting at S. 177th W. Avenue in Section 12, T18N, R10E in District #2. Vote as follows: Stephens- Aye, Moore - Aye, Whitehouse - Aye.

Item #12: Motion was made by Whitehouse and seconded by Moore to approve extending Utility Permit an additional 30 days for Cox Communications Per County Spec for underground fiber conduit path, size of line .459/48 ct., size of line 2" orange PVC conduit, to cross and parallel W. Line St., Route 66, & S. Wickham Rd. approximately 1.09 miles N. of Turner Turnpike, further described as 35' E. of Section 33, T18N, R11E in District #3. Whitehouse stated this was originally approve on 3-17-25, for 90-day, they are requesting an additional 30-day extension. Glen Musser, Project Manager stated they have about two weeks until completion of project. Vote as follows: Stephens- Aye, Moore - Aye, Whitehouse - Aye.

Item #13: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. Andrew Goforth, Assistant District Attorney stated they have five more projects to enter on report, we should be completed by this week.

Public Comment: Stephens stated that today at 1:00 p.m. we will be opening the time capsule on the eastside of building. April 20th was the 100-year mark, but since that was on a weekend I have been trying to get the word out that we will be opening and unveiling the capsule today. Senator Gallihare and the media will be present, along with the Sapulpa Chamber.

Item #14: A motion was made by Stephens and seconded by Whitehouse at 9:30 a.m. to enter to Consider/Action Re: Discussion and possible vote to enter into Executive Session pursuant to 25 O.S., Section 307(B)(4) to discuss with counsel all aspects of pending litigation, including upcoming settlement conference in Ronnie Dwayne Smith v. Bret Bowling, et al., Case No. CIV-20-422-JFH-CDL, filed in the Northern District of Oklahoma, on the advice of and at the request of counsel. Public disclosure of these confidential communications would seriously impair the ability of the Board and its attorney to properly process and defend itself in litigation. Counsel may appear telephonically. Vote as follows: Stephens- Aye, Moore - Aye, Whitehouse - Aye.

Item #15: A motion was made by Stephens and seconded by Whitehouse at 9:30 a.m. to enter Executive Session to Consider/Action Re: Possible Executive Session pursuant to 25 O.S., Section 307(B)(4) to discuss with counsel all aspects of pending litigation, including upcoming settlement conference in Ronnie Dwayne Smith v. Bret Bowling, et al., Case No. CIV-20-422-JFH-CDL, filed in the Northern District of Oklahoma, on the advice of and at the request of counsel. Public disclosure of these confidential communications would seriously impair the ability of the Board and its attorney to properly process and defend itself in litigation. Item #17: Motion was made by Whitehouse and seconded by Moore to appoint Newt Stephens Jr. as Representative to pending litigation in Ronnie Dwayne Smith v. Bret Bowling, et al., Case No. CIV-20-422-JFH-CDL, filed in the Northern District of Oklahoma, with counsel. Counsel may appear telephonically. Vote as follows: Stephens- Aye, Moore - Aye, Whitehouse - Aye.
