The Board of County Commissioners of Creek County (BOCC) met in Special Session on Wednesday, January 24, 2024 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Stephens. Roll Call Stephens present, Warner absent, Whitehouse present. Warner joined the meeting at 9:06 a.m.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: This item was passed until 1-29-24. Consider and take action with respect to a Resolution of the Board of County Commissioners of Creek County, Oklahoma (the "County") approving the incurrence of indebtedness by the Creek County Educational Facilities Authority (the "Authority") issuing its Educational Facilities Lease Revenue Bonds, Series 2024 (Sapulpa Public Schools Project) (the "Bonds"); providing that the organizational document creating the Authority is subject to the provisions of the Bond Indenture authorizing the issuance of said Bonds; waiving competitive bidding and authorizing the sale of said Bonds by the Authority at negotiated sale and at a price less than par; approving the forms of a Continuing Disclosure Agreement and an Official Statement relating to the Bonds; authorizing the execution of all necessary documents, and containing other provisions relating thereto.

Item #8: Motion was made by Whitehouse and seconded by Stephens to sign Resolution#2024-10 rezoning request CCZ-2126 and lot split CCLS-1939-James Barnett per recommendations of CCPC. Rezoning from Agricultural District to Residential Manufactured Home District to allow lot splits. Tract 1 will contain 0.68 acres more or less. Tract 2 will contain 0.75 acres more or less. Tract 3 will contain 0.85 acres more or less. All tracts will meet the requirements of Residential Manufactured Home District and are not located within a flood zone. The tracts are surrounded by Agricultural. Tract 1 will be the primary residence, tract 2 will be the brother-in-law's residence and tract 3 will be a rental. Applicant is present. The CCPC recommended approval on 1/16/24, along with the Planning Office. Property located at 16606 W. King Street, Sapulpa, OK 74066.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Whitehouse - Aye.

 Item #9: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2024-11 rezoning request CCZ-2127 and lot split CCLS-2941-Shane and Edina Thomas per recommendations of CCPC. Rezoning from Agricultural District to Residential Manufactured Home District to allow lot splits. Tract 1 will contain 1.70 acres more or less. Tract 2 will contain 3.50 acres more or less. Tract 3 will contain 17.9 acres more or less; this tract will be tied to the tract to the west as well. All tracts will meet the requirements of Residential Manufactured Home District, with the tying of the west tract to tract 3. Tracts are not located within a flood zone. Tracts are surrounded by Agricultural District. Applicant is present. The CCPC recommended approval on 1/16/24, along with the Planning Office. Property located at 19423 Slick Rd. Kellyville, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

 Item #10: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2024-12 rezoning request CCZ-2129-Thomas Johnson per recommendations of CCPC. Rezoning from Agricultural District to Residential Manufactured Home District to allow one manufactured home. This tract contains two lots and will meet all requirements. Tracts are not located in a flood zone. Applicant is present. The CCPC recommended approval on 1/16/24, along with the Planning Office. Property located at southwest corner of Fourth Street and Cork Avenue Shamrock, OK.-Wendy Murray, Planner.  Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

 Item #11: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2024-13 request approval of Final Plat CCFP-2023-Duck Creek Estates-David Henke residential subdivision consisting of 20 tracts on 80 acres. Murray stated this is 80 acres that will contain 20 tracts. Property is surrounded by Agricultural, Light Residential and the City of Mounds. Property is not located in a flood zone. Applicant is present. The CCPC recommended approval on 1/16/24, along with the Planning Office. Property located at 19363 S. 49th W. Avenue Mounds, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #12: DISCUSSION ONLY/NO ACTION on discussion and possible action to consider case CCPP-2023-07; White Horse Hills; Applicant, Outback Investments, requests approval of preliminary plat for residential subdivision "White Horse Hills", consisting of 26 tracts on 80 acres, subject tract is located at 49301 W. 271st St. S. Stroud, OK.-Wendy Murray Planner. Murray stated the applicant wishes to withdraw application. They are planning to sell the 80 acres in four twenty-acre tracts. The Board allowed the Applicant to withdraw application on There was not vote or action on this item.

Item #13: Motion was made by Warner and seconded by Whitehouse to pass until 1/29/24 discussion and possible action rezoning request approval Preliminary Plat CCPP-2023-06 Hilltop Estates-Bart C. James residential subdivision consisting of 13 tracts and 40 acres. Murray stated the Applicant could not be present and requests the item be passed until 1/29/24. Stephens stated he would like to hear the report from Murray first and then they can make a decision. Tract is surrounded by Agricultural and not located in a flood zone. The water source will be well water and gas will be propane. There has been opposition from neighbors about increased traffic and the manufactured homes locating on small tracts of land. Murray stated she emailed James at 9:05 a.m. on 1/22/24 to state the meeting will be moved to 1/24/24. James stated he did not receive the email until this morning. The CCPC recommended denial on 1/16/24, along with the Planning Office. The Board stated they are good to pass the item.  Property located 39266 W. 141st St. S. Bristow, OK. Wendy Murray, Planner.  Item #14: Motion was made by Stephens and seconded by Whitehouse to award Bid#24-12 Purchase of One or More Used Single Drum Smooth Rollers for Creek County to United Rentals LLC, for a 2018 Hem, with 985.2 hours, in the amount of $45,000.00 located in Tulsa Oklahoma. Stephens asked if the other Commissioner's were interested in the bid, both stated not at this time. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

 Item #15: Motion was made by Stephens and seconded by Whitehouse to sign Resolution#2024-14 supporting the Heart of Route 66 Auto Museum expansion efforts. Stephens stated this is a grant for Route 66 and this would be a good asset for our county and our economy. The museum has received recognition and this would just add to their efforts in expanding the museum. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #17: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2024-16 surplussing a Dell Inspirion One 2320 all-in-one computer/monitor INV#0496 Serial#4WP9BQ1 for the Sheriff and Resolution#2024-16A disposing of the same to be junked. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. Item #18: Motion was made by Stephens and seconded by Whitehouse to pass discussion and possible action to consider directing the Creek County Treasurer to credit the Creek County General Government Insurance Fund (001-2-2300-1222/R4) with a check from Westlake Ace Hardware in the amount of $15.99, as reimbursement for a credit balance, as per 62 O.S. § 335, and procedures implemented by the State Auditor's Office until 1-29-24 for correction of language. Mortazavi asked that this item be passed so the agenda can be corrected to be credited to the 2005/R2 Maintenance and Operations Fund. This was correct on the 2-22-24 agenda, but the Special Meeting Agenda had it incorrect. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

 Item #19: Motion was made by Stephens and seconded by Whitehouse to pass discussion and possible action to consider directing the Creek County Treasurer to credit the Creek County Sheriff's Capital Outlay Account (1226-2-0400-2005/SSF2) with funds from ACCO in the amount of $32,398.50 from ACCO as reimbursement for damages to a sheriff vehicle which occurred on 10-2-23, as per 62 O.S. § 335, and procedures implemented by the State Auditor's Office. Until 1-29-24 to review the account information and correct the agenda language. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

 Item #20: Motion was made by Warner and seconded by Whitehouse to approve Utility Permit from ONE Gas Inc. per County Specs for ¾" natural gas pipeline by boring, size of line ¾" to cross 6317 S. 42nd W. Ave approximately 1.18 miles S. & 1.88 miles W. of US 75 and SH 66, further described s 1,244' S.& 2,143' E. of the N.W. corner of Section 4, T18N, R12E in District #2. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye

Item #21: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. Quarterly Reports have been submitted and accepted; we are in compliance at this time stated Mortazavi. (1) No Roads or Bridges at this time.   

Public: Reminder that the Fair Board sign-ups are going on until 1-26-24 at 5 p.m. Mortazavi stated we have only Bob Pruitt signed up.
