The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, February 26, 2024 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Stephens. Roll Call Stephens present, Warner present, Whitehouse present.

Item #2: Statement of compliance with open meetings act-Chairman.

Item #3: Commissioner Warner led the Pledge of Allegiance and Invocation led by Whitehouse.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2024-27 rezoning request CCZ-2130-Kelley Rickett. Rezoning from Agricultural District to Residential Manufactured Home District to allow one manufactured home. Tract will meet all requirements and is surrounded by Agriculture. The Applicant is bringing the property into compliance with the county. There has been no opposition. Applicant is present. The CCPC recommended approval on 2-20-24, along with the Planning Office. Property located at W. 5th St. South, Terlton,OK.-Wendy Murray, Planner.  Vote as follows: Stephens - Aye, Warner - Aye. Whitehouse - Aye.

Item #8: Motion was made by Stephens and seconded by Whitehouse to sign Resolution#2024-28 rezoning request CCZ-2128-Ronald Root. Rezoning from Agricultural District to Commercial District to allow Trailer/Equipment Sales with conditions placed by CCPC and Stephens stating the Applicant will work with District #1 to make driveway entrance a safe one. Tract will contain 13.66 areas and is surrounded by Agricultural District and the City of Kellyville. Murray presented two emails from concerned residents about the area being rural and the safety issue with the proposed entrance. Applicant is present. Stephens stated he will review the speed limit and if there needs to be an adjustment, they will do so by resolution and board approval. I agree 161st is a busy street, with lake access, but I think this is a good fit for the area. The road recently been improved by the county and it is now maintained by the county. Warner addressed the concern of the CCPC with the entrance and asking the applicant to work with the Commissioner for a safer entrance. Stephens spoke with Applicant and they agreed to work with District #1 on a safer entrance. Applicant is present. The CCPC recommended approval with conditions on 2-20-24, along with the Planning Office. Property located at 23766 W. 151st St. S. Kellyville, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Warner - Aye. Whitehouse - Aye.

Item #9: Motion was made by Stephens and seconded by Warner to sign Resolution#2024-29 calling for special election to fill the balance of the unexpired term of office of the County Treasurer (July 1, 2025 - June 30, 2027) to be held simultaneously with the 2024 county general election, and for said office to be listed on the same ballot as other county offices. Stephens asked if this requires additional publication with the paper. Andrew Goforth, Assistant District Attorney stated no, this is the cause of notice. There was discussion that this should have followed the action of appointment back in August. We are just now getting the paperwork caught up to have it on the 2024 ballot. Vote as follows: Stephens - Aye, Warner - Aye. Whitehouse - Aye.

Item #10: Motion was made by Warner and seconded by Whitehouse to sign the adjusted 2023 Five-Year Exempt Manufacturing Claim, Form 969, from the Oklahoma Tax Commission to receive tax reimbursement, in the amount of $ 9,933,853.00. Haley Anderson stated that OTC contacted them after the first submission and added an additional asset that qualified as an exemption in the amount of $9,402.00. Vote as follows: Stephens - Aye, Warner - Aye. Whitehouse - Aye.

Item #12: Motion was made by Stephens and seconded by Warner to sign Resolution#2024-31 creating an account for the REAP Grant pass through funds for Creek County Rural Water District #5, Account 1425-3-1300-2324. There was discussion of the funds will be handled by the county and that they will go through the county purchasing laws. Vote as follows: Stephens - Aye, Warner - Aye. Whitehouse - Aye.

Item #13: Motion was made by Stephens and seconded by Whitehouse to sign a division order between Creek County and Dorado Oil Company on property located in Section 28, T19N, R09E (0.00156250 Interest). Vote as follows: Stephens - Aye, Warner - Aye. Whitehouse - Aye.

Item #14: Motion was made by Warner and seconded by Whitehouse to approve Utility Permit from Magellan Pipeline Company LP per County Specs for 12" pipeline, existing pipeline depth to cover maintenance to cross W. 171st St. S. approximately 0.1-mile W. of S. 545th W. Ave, further described as 4.696 E. of Section 30, T17N, R7E in District #2. Warner stated they have been working with Magellan for a while and he will work to make sure they do the permit per county specs. Warner stated they will be raising the road that goes over the pipeline, this will not create an issue. Vote as follows: Stephens - Aye, Warner - Aye. Whitehouse - Aye.

Item #15: Motion was made by Whitehouse and seconded by Warner to approve Utility Permit from Oklahoma Gas and Electric Company per County Specs for underground electric line, size of casing 2/c 0AL(515) to cross S. 369th W. Ave approximately 0.22 miles S. of S. 369th W. Ave & W. 241st St. S., further described as 80' E. of Section 36, T16N, R8E in District #3. Vote as follows: Stephens - Aye, Warner - Aye. Whitehouse - Aye.

Item #16: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. (1) Motion was made by Stephens and seconded by Warner to let for bid #24-16 Supply and Install Aeration System and Lift Station Backup Generators for Town of Kellyville and to update the ARPA Project number from 1566-6.1-74039-4110 to 1566-5.2-74039-4110 to be opened 3-25-24. Vote as follows: Stephens - Aye, Warner - Aye. Whitehouse - Aye. (2) Motion was made by Warner and seconded by Whitehouse to approve Transfer for publication $234.32 from 1566-1-1302-4110 Kellyville ARPA Sewer/Water Commissioners FY2023-2024 to 1566-1-1302-2005 Kellyville ARPA Sewer/Water Commissioners FY2024. Vote as follows: Stephens - Aye, Warner - Aye. Whitehouse - Aye. (3) No Road and Bridge projects at this time from District #3.
