Notice is hereby given that the Creek County Board of County Commissioners on behalf of the City of Sapulpa / Sapulpa Municipal Authority, Oklahoma hereinafter called the "City" or "Owner" will receive sealed written bids from qualified bidders at the County Clerk's Office located at 317 E Lee Street, Room 100 in Sapulpa, Oklahoma, until 8:59 AM (CST) on the 27th day of February 2023. The bids will be publicly opened during the Board of County Commissioners meeting in the commissioner's conference room 103 beginning at 9 AM. Bids shall remain valid for 60 days from bid opening. Electronic bid submission will not be accepted.

Brief Project Description: The existing West Pump Station houses a total of six (6) high service potable water pumps, each 150 HP, serving two different pressure planes in Sapulpa. The proposed backup generator will provide emergency backup power for up to three (3) pumps. The proposed generator is a 500 KW, diesel fuel fed completely packaged unit with integral double-wall fuel tank. The proposed generator will be supported on an elevated concrete support pedestal.
All work shall be performed, and all construction and material used and furnished shall be in accordance with the Plans, Specifications and contract documents prepared by S2 Engineering, PLLC, 8556 E. 101st Street, Suite D, Tulsa, Oklahoma 74133, and on file in the office of the City Clerk for the City of Sapulpa, Oklahoma and Creek County Clerk's office.
The Notice to Bidders, Form of Bid, Form of Contract, Plans and Specifications, Forms of Bid Bond, Performance and Statutory Payment Bond, and other Contract Documents may be examined at the following:

A complete set of Plans and Specifications for prospective bidders may be obtained at S2 Engineering office only, upon receipt of a non-refundable payment of $ 45.00 for an electronic (pdf) set of bid documents or $95.00 for a hard copy (paper copy) set of bid documents. No partial sets of bid documents will be made available.
Each bidder shall accompany his original bid with a certified or Cashier's Check on a solvent bank located in Oklahoma or a Bidder's Bond, in the amount of five (5) percent of the amount bid, and the same will be retained by the County on behalf of the City until the successful bidder has entered into a written contract with the Owner and a satisfactory performance bond has been furnished. The bid deposit of the unsuccessful bidders will be returned upon the execution of the Contract and required bonds.
Each bidder shall accompany his bid with a sworn statement in writing that the Bidder has not directly or indirectly entered into an agreement, expressed or implied, with any other bidder concerning the price or amount of such bid or any bids, the limiting of the bids or bidders, the paying to anyone any money for promotion expenses, the parceling or farming out to any bidder or bidders or other persons of any part of the contract or any part of the subject matter of the bid or of the profits thereof.
Construction, Maintenance and Statutory Payment Bonds in the amount of 100% of the contract price with a Corporate Surety licensed in Oklahoma and approved by the Owner and Engineer, will be required for the faithful performance of the contract, and the bidder shall state in the proposal the name and address of the Surety or Sureties who will issue this bond in case the contract is awarded to him. The Maintenance Bond required will guarantee the repair of all damage due to improper materials or workmanship for a period of one (1) year after the acceptance of the work by the Owner.
Funding for this project is provided through American Rescue Plan Act (ARPA) grant program. As such, compliance with Labor Standards Contract Provisions is mandatory. Compliance with the Davis Bacon Act is mandatory if the total project cost exceeds $10,000,000 (ten million dollars).
This project is to be financed by the ARPA grant program. The following requirements and regulations must be complied with:
- "Equal Opportunity in Employment: All qualified applicants will receive consideration for employment without regard to race, color, religion, sex, national origin, age or physical handicap. Bidders on this work will be required to comply with the President's Executive Order No. 11246, as amended.
- "Each bidder must fully comply with the requirements, terms and conditions of the Environmental Protection Agency's Disadvantaged Business Enterprise Requirements, which have been adopted for the OWRB ARPA program, and include employing the six (6) good faith efforts and soliciting disadvantaged business enterprises during the performance of this contract. Requirements are contained in OWRB's Guidance and Procedures, ARP-267. The bidder commits itself to following the good faith efforts to solicit disadvantaged business enterprises contained herein and all other requirements, terms, and conditions of these bid conditions by submitting a properly signed bid."
- System for Award Management (SAM) registration is required for all Applicants and Awardees (Entities, Prime Contractors, Subcontractors, Vendors) in order to receive funds from the ARPA program. SAM replaced the Central Contractor Registration/Federal Agency Registration, Online Representations and Certifications Application, and Excluded Parties List System. Applicants and awardees are required to complete a one-time free registration to provide basic information relevant to procurement and financial transactions. On April 4, 2022, the unique entity identifier used across the federal government changed from the DUNS Number to the Unique Entity ID (generated by SAM.gov). Registrants must retain an active status to be eligible for ARPA funding. Applicants and Awardees can go to SAM.gov to complete the registration process.
Contract to be awarded to the lowest responsive responsible bidder after evaluation and recommendation by the engineer, S2 Engineering.
A Non-Mandatory Pre-Bid Conference will be held for this project in the City Hall of Sapulpa, located at 425 E Dewey Avenue, Sapulpa, OK 74067 at 1:30PM. on the 17th day of February 2023, in Sapulpa, Oklahoma.
The Owner reserves the right to waive any informality in the bidding.
The County and City reserve the right to reject any and all bids in accordance with the Oklahoma Competitive Bidding Act. Conditional bids shall not be accepted.
